Dear Abellio East Midlands Limited,

Because of the impact of Covid-19, the Government, inline with Train Operating companies, introduced the Emergency Measures Agreements (EMA) which resulted in direct funding via the tax payer through the Government and due to this, and other factors, the Office Of National Statistics now states (from the 1st of April 2020) that TOC's including EMR are under Public Sector Control.

Due to the brief information from the above paragraph, does EMR recognise that it has to be compliant with the Public Sector Equality Duty and give Due Regard of its legal implications and requirements.

If so, or not, could you provide some form of evidence accordingly.

With my freedom of Information request, with the deadline now being passed, whilst you should have replied promptly by law, with the deadline being the 13th of December 2021, I now wish for an immediate response to my request. I am writing to request an internal review of Abellio East Midlands Limited's handling of my FOI request 'Due Regard of The Public Sector Equality Duty'.

After being in contact with the Information Commissioners Office I have been advised that you are potentially legally bound by the duties of Freedom Of Information Requests due to your classification of being Public Sector Control by the Office Of National Statistics. I have been advised to carry out this Internal Review and then contacting the ICO if you are still in denial of your legal responsibilities and compliance.
