Drainage Services Contract Awards

Please can you tell me what current/live contracts exist for the provision of drainage and/or drainage related services.

This could include the clearing, cleaning, investigation (CCTV), repairing and installation of drainage systems (to include septic tanks and gullys) within, highways, social housing stock and other council owned properties.

Please include both framework and direct contract arrangements.

The details I require are:
• Suppliers who applied for inclusion on each framework / contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on each contract / framework (and any sub lots), from the start of the contract to the current date
• Start date & duration of each framework /contract
• Is there an extension clause in each of the framework /contract and, if so, the duration of the extension?
• Has a decision been made yet on whether each framework /contract are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for each contract / framework?

NELC/20715/2021. I wish to confirm that North East Lincolnshire Council
holds the following information.

 

Please can you tell me what current/live contracts exist for the provision

We do not have a Framework for drainage works.

The information you have requested in relation to successful and
unsuccessful tenders has been considered under section 43 of the Freedom
of Information Act which states that:

 

(1) Information is exempt information if it constitutes a trade secret.

(2) Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it).

(3) The duty to confirm or deny does not arise if, or to the extent that,
compliance with section 1 (1) (a) would, or would be likely to, prejudice
the interests mentioned in subsection (2).

 

Section 43 is a qualified exemption, and requires consideration of whether
the balance of public interest is to disclose or withhold the requested
information, before the exemption can be applied. The public good may
differ from the private interests of an individual requester and in this
respect the test is undertaken under the principal of being applicant
blind. North East Lincolnshire Council will always begin from the position
that information should be disclosed. All public interest tests are
undertaken by the Information Governance team with input from any relevant
information owners.

 

In assessing the public interest the following factors, were considered in
favour of disclosure:

 

·         The public interest in understanding the activities of North
East Lincolnshire Council, to inform their decision making, allow them to
challenge the decisions and actions of the council and participate in
debate;

·         The public interest in ensuring North East Lincolnshire Council
can be held accountable for its decisions;

·         The public interest in ensuring North East Lincolnshire Council
are able to effectively provide services and deliver outcomes for the
community;

·         The public interest in ensuring North East Lincolnshire Council
are providing value for money services.

 

The following factors were in favour of withholding the information:

 

·         The effect disclosure would have on the commercial interest of
the third parties in a competitive environment;

·         The effect disclosure would have on the ability of North East
Lincolnshire Council to negotiate or compete in a commercial environment.

·         The impact that disclosure may have on the reputation or
customer confidence of a third party and the damage this may cause to its
commercial interests through loss of trade.

·         The impact that disclosure may have on negotiations on other
contracts and procurements. 

 

It is evident that the overriding factor to consider is the impact
disclosure may have on North East Lincolnshire Council’s tender process
and the impact disclosure may have on the confidence of potential bidders
who may want to take part. Unsuccessful bidders do not expect their
details to be released in relation to bids they have not been selected
for. It would prejudice their commercial interests as the fact they were
unsuccessful would be released without any context or information
regarding why they were not successful on this occasion. This commercial
prejudice would be unfair and would discourage participation in future
North East Lincolnshire Council bids, ultimately impacting on our ability
to ensure best value for money for the residents of North East
Lincolnshire.

 

In assessing the balance of public interest in relation to section 43 it
is determined that the balance of public interest is to withhold this
information in relation to successful and unsuccessful tenders.

Estimated contract values have been provided as both projects are live and
have not invoiced yet.
