'3. The allegation against Dr Bajaj is that, on three separate occasions he gave evidence, either in a written statement or in oral evidence, that he had only worked the night-shift on 12 February 2010 when in fact it is alleged that he also worked the day shift on that date. The first occasion was in a written statement to the Metropolitan Police on 25 February 2011. The second occasion was in oral evidence at the criminal trial of Mr C, before the Central Criminal Court, on 10 October 2013. The third occasion was when giving oral evidence before the MPTS, in the GMC proceedings against Mr C, on 6 February 2018. It is alleged that in giving this evidence Dr Bajaj knew that the evidence he provided was untrue
and that he was dishonest.

Having determined that a reasonable Tribunal could conclude that the statements made in paragraphs 1, 2 and 3 of the Allegation were false, and that Dr Bajaj did work the day shift on 12 February 2010, the Tribunal went on to consider whether there was sufficient evidence that a reasonable Tribunal could conclude, in those circumstances, that Dr Bajaj knew that the statement he made and the evidence he gave was untrue and therefore dishonest.

62. The Tribunal determined that there was insufficient evidence adduced to prove paragraphs 4 and 5.'

In light of its findings, the Tribunal invited submissions from the parties as to whether the hearing should proceed, it being The Tribunal’s understanding that the GMC did not invite a finding of misconduct against Dr Bajaj on the basis of paragraphs 1, 2 and 3 of the Allegations alone. Mr Morwood confirmed that, in light of the Tribunal’s findings as to the sufficiency of evidence on paragraphs 4 and 5, they did not seek to proceed with the case against Dr Bajaj and in those circumstances the Tribunal directed that the hearing should proceed no further.'
