Dr Bill Kirkup's investigation into the death of Elizabeth Dixon

Dear Parliamentary and Health Service Ombudsman,

A report by Dr Bill Kirkup - 'The Life and Death of Elizabeth Dixon: A Catalyst for Change' - has recently been published:

Shaun Lintern of the Independent newspaper writes that:

'It is telling that at every turn the state dismissed them. Whether it was a “sham” coroner’s investigation, a “seriously flawed” police inquiry or the disinterest paid to Elizabeth by NHS England’s chief executive Simon Stevens and the former Parliamentary and Health Service Ombudsman, who both singularly turned their back on the family in 2014.'

In his foreword, Dr Kirkup observes that it is 'greatly regrettable that some of those who were contacted refused to take part in interviews.'

I have checked the list of those who were interviewed in connection with the investigation (pages 109/110) but can see the name of no one from the PHSO.

1. Was anyone from the PHSO invited to take part in the investigation carried out by Dr Kirkup? If so, please provide a copy of the invitation.

2. If the PHSO declined to partipate, please provide a copy of the communication declining the invitation.

Dr Kirkup is an member of the PHSO's Expert Advisory Panel:

'The Expert Advisory Panel provides a non-executive advisory function to the Ombudsman. Members are not PHSO employees and the Panel is not a decision-making forum. Members were selected on the basis of fair and open competition. The Panel is distinct from our Board and members offer challenge and support in general and in specific areas of PHSO’s work where the Ombudsman would find that useful. This has included providing advice on casework-related matters and involvement in the development of the draft Complaint Standards Framework. Panel members are accountable directly to the Ombudsman and are called upon individually to work on projects and other activity as agreed by the Ombudsman. The Panel meets collectively from time-to-time.

Membership terms are limited to two years, with the option of annual extensions up to a total of five years. This will ensure the Panel’s expertise is relevant to the changing priorities of the organisationand capable of being refreshed.'

' Dr Bill Kirkup

Bill Kirkup qualified in medicine from Oxford in 1974, then trained in obstetrics and gynaecological oncology, and later in public health. He held public health and management posts in the North East before becoming Associate Chief Medical Officer for England.

Since leaving full-time practice in 2009, Dr Kirkup has led investigations into public service failures, including:

children’s heart surgery in Oxford
Jimmy Savile’s involvement at Broadmoor Hospital
Morecambe Bay maternity services
Liverpool community services. 

He served as a member of the Hillsborough Independent Panel and the Gosport Independent Panel.

Bill worked on public health and reconstruction as a civilian volunteer alongside military operations in Kosovo (1999), Baghdad, Iraq (2003, 2005) and Afghanistan (2007/08).'

'Harmed patients and their families have consistently been the driver behind major healthcare inquiry reports which often happen only after the cumulation of years of arduous battles against the system at great personal cost. Nadine Dorries is right to describe this as “inhumane,” but the best way to honour those affected is not through words but by acting on the recommendations and changing the system once and for all.'

'5. In your written evidence, you describe the establishment of a new Expert Advisory Panel, which brings support and challenge to improve the organisation. Could you please provide more information on:

a. How the panel works in practice, and how the panel brings support and challenge to the PHSO;

b. How long panel members’ tenure lasts; and

c. Whether you have plans to change the panel’s membership from time to time, to ensure there is always fresh external challenge.' (WW)

We can confirm that the Parliamentary and Health Service Ombudsman was not
invited to take part in the investigation carried out by Dr Bill Kirkup.
