Dorset Police fail to respond to a SAR - Dec 2020

We're waiting for B domenic to read recent responses and update the status.

Dear Information Commissioner's Office,

Dorset Police fail to respond to a SAR and explain to me that it has already contacted you; that it accepts delay in responding to my SAR request and notifies you the same. I'm not satisfied the force do so to serve common interests; I suspect its designed to serve its own interests period. In notifying you it has 'officialized' delay according to its own agenda for reasons which ignore if not undermine my interests.

The forces failure to respond to my SAR affects me: my request concerns, among other things, numerous crimes, reported to the force over many years, which are neither recorded nor acknowledged (inc. racist hate crimes). It also concerns complaints made against the force, such as details of the forces efforts to indict me as the victim of a crime rather than the criminal, who admitted the crime. These are ongoing concerns.

I'd imagine it would be wise to make my own complaint to the ICO in order to offer you my 'version of events'. You would learn for example that I've been protesting access to the information for years.

So, according to FOI Act, kindly supply me copy of your policy or procedure dealing with the above. In short, are you prepared to receive my complaint against Dorset Police?

Dorset Police are the worst when it comes to responding to SARs, according to this ICO report titled 'Timeliness of responses to information access requests by police forces in England, Wales and Northern Ireland':

I'm reiterating my FOI query for clarity. The original query is given below.

Dorset Police fails to respond to a SAR and explains that it has already contacted you; that it accepts delay in responding and notifies you the same. For reasons identified in my original query, I'd like to make my own complaint to you about Dorset Police's failure to respond to SAR. So, with reference to your policy document, confirm you wish to deal with my complaint*. A copy of the policy document should be made available as attachment given that the link offered me ("Service guide" link January 2021) failed to deliver; whether it's pertinent info' or not. FYI: I tried the link several times both this week and last using different browsers.

*respectfully, as addendum to the query, I think it not unreasonable to ask you simply confirm whether or not you wish to deal with my complaint. FOI Act Section 16 supports me here; suggests the same. Not sure why you didn't do so last time; in failing to do so you delay the matter.

Review of response to information request

I write further to your email of 27 May 2021 in which you requested a
review of the handling of your request dealt with under the reference
number IC-79420-H8Q3. I sincerely apologise for the delay in responding to
your request for a review. 
 
As a result of your email of 27 May (and subsequent correspondence) we
have conducted an internal review of our response to the information
request that was handled under the above reference number. I am a Team
Manager in the Information Access Team and I can confirm that I have had
no prior involvement in the handling of this request.

Request and response

On 18 December 2020 we received a request from you which said:

‘So, according to FOI Act, kindly supply me copy of your policy or
procedure dealing with the above. In short, are you prepared to receive my
complaint against Dorset Police?’

On 12 January 2021 we responded, withholding the information in reliance
upon s21 of the FOIA, because the information you sought was already
reasonably accessible to you via other means, namely the ICO Service
Guide, which could be found on our website. A link to the Policies and
Procedures area of the website, where the Service Guide is situated, was
also provided.

Review
 
The purpose of this review is to look again at your request and the
response that was provided to you, to ensure it was correct and that any
exemptions applied were appropriate.

I can confirm that I have reviewed the correspondence on the information
request and am wholly satisfied that the response you received was
correct.

As Eluned Cook explained in her acknowledgement email dated 22 December
2020, the only part of your email of 18 December to be considered under
the Freedom of Information Act (FOIA) was your request for a copy of our
policy or procedure relating to complaints. This is because the FOIA
entitles you to information held by a public authority, and is not an
appropriate avenue to seek advice. The response of 12 January 2021
addressed this and clearly stated that information in the scope of your
request was held, but withheld from disclosure as it was already
reasonably accessible to you by other means.

For these reasons, I am confident that the original response was
appropriate and therefore your review is not upheld. I apologise again for
the delay in this reply.
