FREEDOM OF INFORMATION ACT 2000-INFORMATION REQUEST

 

Your request for information has been considered under the requirements of
the Freedom of Information Act and our response is as follows:

 

With regard to questions 1&3 this address was The Chancellor's House, 1
Richmond Street, Leicester, LE2 7LQ.

 

With regard to question 2 we are withholding this information under
Section 40(2) of the Freedom of Information Act which covers third party
personal data. Under this exemption information can be withheld from
disclosure if its release would contravene any of the Data Protection
principles. In this instance we have determined that release of this
information would contravene the first principle, which is that the
processing of personal data should be lawful, fair and transparent. In
making our decision we have determined that in respect of this request the
disclosure would not fulfil the first branch of the principle, in that it
would not be lawful. The only lawful basis we could use for this
disclosure would be Legitimate Interests. In order to assess whether a
disclosure under Legitimate Interests would be lawful we need to consider
the purpose of the disclosure, the necessity of the disclosure and then
conduct a balancing test to determine if the legitimate interest outweighs
the interests and rights of the individual.

 

There is no obvious purpose to releasing the private address of a former
employee into the public domain, and as such we can determine no necessity
to do this. Given there is no clear legitimate interest in releasing this
information, the release of this information cannot outweigh the rights of
the individual, especially given the potential harm that could clearly
arise in releasing the private address of any individual, be they former
or current staff member or student, or a member of the public, into the
public domain.
