• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

I am writing to confirm that Middlesbrough Council has now completed its
search for the information you requested on 10^th April 2022.  Your
request has been considered in accordance with the requirements of the
Freedom of Information Act. 

 

In your request you asked for the following information:

 

1)         What are the contractual performance KPI's for this contract?

start of the contract to the current date

Response:

 

1)         These are outlined in the specification attached.

 

2)         There were 3 bidders for this contract. Contract was awarded to
harbour. The other bidders are not named as this is deemed commercially
sensitive information and not in the public domain.  This information is
exempt under section 43 (Commercially sensitive) of the FOIA.  Section 43
states:

 

(1) Information is exempt information if it constitutes a trade secret.

 

(2) Information is exempt information if its disclosure under this Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it).

 

(3) The duty to confirm or deny does not arise if, or to the extent that,
compliance with section 1(1)(a) would, or would be likely to, prejudice
the exemptions mentioned in subsection (2).

 

Section 43 is a qualified exemption, and accordingly we had to consider
whether the public interest is in withholding the information or in
disclosing it.

 

The ICO defines ‘commercial interest’ as “a person’s ability to
participate competitively in a commercial activity i.e. the purchase and
sale of goods or services.” We consider that information submitted to the
Council in order to bid for a contract would naturally fall within the
definition of a commercial interest.

 

The Council acknowledges that there is a public interest in the scrutiny
of how public money is spent.  However, we consider that the information
relating to unsuccessful bidders is exempt from disclosure citing Section
43 (2) (Commercial Interests) of the Freedom of Information Act 2000 on
the grounds that disclosure would, or would be likely to be, prejudicial
to the commercial interests of the third parties.

 

3)         Contract Value is £164,592 for the contract term – 3 years

 

4)         Start date – 01.04.21. Contract term 1 year

6)         Extensions available 2 x 12months

 

7)         One extension term taken
