Dog Fouling - Land Designation

Response to this request is long overdue. By law, under all circumstances, Tower Hamlets Borough Council should have responded by now (details). You can complain by requesting an internal review.

Dear Tower Hamlets Borough Council,

The Dogs (Fouling of Land) Act 1996 identifies the regulations applying to this Act.

It states that a Local Authority: "A local authority may by order designate for the purposes of
such land. this Act any land in their area which is land to which this Act applies; and
in this Act "designated land" means land to which this Act applies which
is for the time being so designated".

What areas in E14 are not designated, such that the Act has no relevance?

Has Tower Hamlets received any application from land owners to exclude them from the Act?

It may be that some areas of land are not be designated, within Tower Hamlets, and not covered by the Act.

What powers then exist for penalties to be applied to a person in charge of a dog, when fouling occurs on private roadways, pavements and estates?

Who can issue penalty notices for dog fouling on land not designated by Tower Hamlets, and under what authority?

Dear Tower Hamlets Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Tower Hamlets Borough Council's handling of my FOI request 'Dog Fouling - Land Designation'.

My question with regard to who has authority to issue penalty charges has not been answered. It would appear from the government paper that only the local authority can do so, and not a private management company.

If the local authority are the only people that are able to issue penalty charges, then they should not be able to opt out of responsibility because of a private estate where residents contribute council tax.

Please clarify.
