Do you mean by this you require the complaints about licence holders, or
all complaints relating to animal activity licensing.

 

The Freedom of Information Act requires a copy of information requested to
be provided within 20 working days of receipt of the request.  However,
under section 1(3) of the Act, where a public authority –

 

(a)  reasonably requires further information in order to identify and
locate the information requested, and

 

(b) has informed the applicant of that requirement

 

the authority is not required to comply with the request until that
further information is provided.

Dear Basingstoke and Deane Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Basingstoke and Deane Borough Council's handling of my FOI request 'Dog Breeding Licences'.

The copy dog breeding licences that I have been provided with in response to my FOI request have been redacted to such an extent that it is not possible to identify the licence holder.

I do not believe that the licences should have been so severely redacted. The request is lawful, fair and transparent. The licence holder has already put their details in the public domain by applying for a licence (which is a matter of public record) to breed dogs. There would be no point in having a licensing regime in place if nobody can identify who the licence holders are.

The purpose of the request is to identify licence holders, the number of breeding dogs kept by each licence holder, the star rating of each licence holder and any special conditions that attach to each licence. I believe there is a legitimate interest in collecting this data.

In the event that the licence holder carries on the regulated activity at a residential address I am happy for the address to be redacted.

In response to the question about staff employed by licence holders I believe there has been an error and I have been provided with details of staff employed by the council. Please provide details of staff employed by the licence holders.

The question about information recorded by the council requires an answer about what the council holds in their records and not what the applicant puts in the application form.

I am writing to request an internal review of Basingstoke and Deane
Borough Council's handling of my FOI request 'Dog Breeding Licences'.

The copy dog breeding licences that I have been provided with in response
to my FOI request have been redacted to such an extent that it is not
possible to identify the licence holder.

I do not believe that the licences should have been so severely redacted.
The request is lawful, fair and transparent. The licence holder has
already put their details in the public domain by applying for a licence
(which is a matter of public record) to breed dogs. There would be no
point in having a licensing regime in place if nobody can identify who the
licence holders are.

The purpose of the request is to identify licence holders, the number of
breeding dogs kept by each licence holder, the star rating of each licence
holder and any special conditions that attach to each licence. I believe
there is a legitimate interest in collecting this data.

In the event that the licence holder carries on the regulated activity at
a residential address I am happy for the address to be redacted.

In response to the question about staff employed by licence holders I
believe there has been an error and I have been provided with details of
staff employed by the council. Please provide details of staff employed by
the licence holders.

The question about information recorded by the council requires an answer
about what the council holds in their records and not what the applicant
puts in the application form.

Thank you for your email of 25 November.  I can confirm I have carried out
an internal review into your request for a copy of dog breeder licences
issued by the council.

 

The Licensing of dog breeders is the responsibility of local authorities
under The Animal Welfare (Licensing of Activities Involving Animals)
(England) Regulations 2018.  Under this legislation dog breeders are
required to obtain a licence.  However, there is no requirement for a
 register of licensed breeders.  Individuals applying for a licence are
not putting their personal details into the public domain by doing so and
there is unlikely to be any expectation that the council will disclose
these details into the wider public domain under FOI.

 

Where the breeder advertises under their name, or there is a company name,
this information has been provided in the attached document, but personal
addresses and names of breeders who do not advertise remain exempt under
s40(2).

 

In respect of staff employed and qualifications – where no additional
staff are employed, it is considered the qualifications of individuals are
personal data and exempt under s40(2).  Where this information has been
publically provided by the breeder it is disclosed.  This information can
be found below:

 

·        Licence 1 – Shadowsquad – KC registered. 9 additional staff;

·        Licence 2 – KC registered.  No additional staff;

·        Licence 3 – Jane Pearman – KC Registered. Veterinary nurse.  No
additional staff;

·        Licence 4 – Cold Waltham Gundogs KC registered.  No additional
staff

·        Licence 5 – Julie Stainer – KC Registered. Veterinary nurse.  No
additional staff

Dear Jackie Tatam,

It appears we are unable to agree the point as regards S40 and personal data.

Whilst the majority of responses to date have resulted in the provision of copy licences that clearly identify the licence holder (addresses redacted in some cases), yours is the third council to decide not to provide copy licences that identify the licence holder. Whilst I disagree with your decision I do appreciate that it is one you have considered carefully.

I have already made one formal complaint to the ICO. Now that there are two other councils who take the same view (and there may be more in future responses) I have asked the ICO to consider these cases as one group. This will hopefully save time for everyone involved and provide some clarity as well. Of course, ultimately it is for the ICO to decide how it wishes to deal with cases and I have yet to have any response from them.

I just wanted to let you know that whilst I am not making any formal complaint to the ICO at present I may do so in the future.

Despite our disagreement on one point I am very grateful to you and your colleagues for the manner in which you have dealt with my FOI request. We are all working under very difficult circumstances at the present time and I really do appreciate the effort put in to the response.
