Diversion of Income – Claiming Personal Expenses Using Company Funds

Dear Her Majesty's Courts and Tribunals Service,

1. Starting from the year the tribunal was first set up, please could you provide a year-by-year breakdown of the number of First-tier Tribunal (Social Security and Child Support) cases relating to the diversion of income by the Non-Resident Parent (NRP) through claiming personal expenses using company funds. Of these cases, please could you provide the number where the tribunal deemed a diversion of income to have occurred. So for example, please could you provide the figures X & Y as follows:

2012: X cases, of which tribunal deemed Y cases where diversion occurred
2013: X cases, of which tribunal deemed Y cases where diversion occurred
2014: X cases, of which tribunal deemed Y cases where diversion occurred
Etc.

2. Please could you provide the same data in the same format for Second-tier Tribunal (Social Security and Child Support) cases.

Dear IAC KILO,

Thank you for your response dated 18th March 2020. I find it incomprehensible that you don't have a centralised database system that could be used to quickly look up the information requested. Surely you must have a facility to look up case law? Firstly, I'd appreciate if you would review whether my request could be achieved via a centralised database or similar system.

Secondly, while you suggest I should reduce the scope of my request, it was the MoJ that grouped four of my FoI requests into one in the first place. If my requests are seperated back into their original four requests, would this be enough to stop Section 12(2) applying? If not, then I would be willing to accept either of the following as an alternative:

(a) Remove the year by year breakdown for each of the four FOI requests, instead providing a single total number of cases for each FOI request, together with the number where the tribunal deemed a diversion of income had occured

Or

(b) Keep the year by year breakdown for each of the four FOI requests, but only go back 5 years. Of if this is still too much, I would be willing to accept 3 years.

I hope you are now in a position to comply with the FOIA.
