Dissemination of defamatory third party communications at Hearings.

Susan Murray made this Rhyddid Gwybodaeth request to Housing and Property Chamber First-tier Tribunal for Scotland

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Dear Housing and Property Chamber First-tier Tribunal for Scotland,

This request relates to a case where at the conclusion of a Hearing of The Housing and Property Chamber, First Tier Tribunal for Scotland, the Chairperson distributed documents which were defamatory of the tenant. This was an unlawful act on the part of the Housing and Property Chamber First Tier Tribunal for Scotland.

The case in question was that of criminal landlord, Michael Monk, property: Addiewell, Glasgow Road, Sanquhar, Dumfriesshire, DG4 6BZ. The Hearing was in cAugust 2017.

Is it the policy of this body to act as a distributor of defamatory material on behalf of the landlord and his agents?

Has a complaint been made in respect of this?

Has there been a notification to proceed with legal action for libel?

Given this throws into doubt the independence of the Tribunal, has a legal opinion been sought concerning this conduct?

The Chairperson on the day was one Ms Taylor. She displayed gross bias towards the landlords on numerous occasions in this case, have complaints been received about her unlawful conduct?

Yours faithfully,

Susan Murray

Dear Housing and Property Chamber First-tier Tribunal for Scotland,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Housing and Property Chamber First-tier Tribunal for Scotland's handling of my FOI request 'Dissemination of defamatory third party communications at Hearings.'.

The response from you fails to be in the public interest in relation to this matter.

The Chairperson of a hearing of Housing and Property Chamber, The First Tier Tribunal for Scotland, distributed material which was defamatory of the tenant. A complaint was made but this was dealt with unlawfully which is the norm for this body. Legal proceedings were initiated and are to be commenced soon.

Given this is supposed to be an independent judicial body and cannot display bias, the whole sordid affair needs to be addressed as it is in the public interest to do so.

I shall await your truthful and accurate response to this request.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/d...

Yours faithfully,

Gadawodd Susan Murray anodiad ()

A typical response from The Judicial Office for Scotland who fail to address serious issues in relation to The Housing and Property Chamber, First Tier Tribunal for Scotland. This is clearly a corrupt body which acts unlawfully but there is no effort to change it. The reason for their appalling conduct is thought to relate to the corruption of Freemasons within it colluding with others who have an interest in the proceedings. The official attitude is to allow them to act unlawfully without any censure.
