Disparity of pay for (care) agency workers and Trust staff

We're waiting for Joan Corrigan to read a recent response and update the status.

Dear Business Services Organisation (Northern Ireland),

UNISON have informed me that BSO have written to all NI care agencies to tell them that they must pay their staff the same per night as Trust staff. Up until recently, many agencies were paying staff less between the hours of 6am to 8am Mon to Fri, which violated/ violates agency workers regulations. This practice has been going on for years.

1) As this is public money and public health, where money and contracts must be accounted for and transparent, I request under FOI law a copy of that letter.

2) Since BSO became aware of this, does it have plans to establish a system where agencies provide back pay for the years which they paid incorrect wages to their workers?

Dear FOI BSO,

On 22 April, you wrote (to me)

"The matter of payment resides between agencies and individual HSC Trusts and
agencies and the individuals. "
BSO's statement was in response to my question, which is below,

"Since BSO became aware of this, does it have plans to establish a system
where agencies provide back pay for the years which they paid incorrect
wages to their workers? "

In its answer above, the BSO seems to be distancing itself from responsibilities around pay and back pay to agency workers.

However, a manager from a NI agency has written to me, on 27 May 2021, in relation to back pay and said

"Any back-payment that is actionable would need to be approved by the BSO "

Can the BSO now clarify

1.Why is the BSO pretending to have nothing to do with backpay, when a NI agency manager says the backpay can not be paid without BSO's apprroval?

2. Please outline all action since the 4 March 2021 letter referred to in your 22nd April response, sent / communicated to all care agencies in NI, and Trusts, to ensure that Trusts and agencies know that BSO will not obstruct any backpay sign offs. And that on the contrary, as your 4 March letter infers, paying workers the legal, parity rate is important to the BSO.

3. please Outline CLEARLY all pertinent issues within discussions, meetings, and written correspondence, between Trusts, BSO and agencies in relation to the delay in changing the rates over to the new, legal, higher rate for agency workers, since the March 4th letter was issued.

4. please Outline CLEARLY all pertinent issues within discussions, meetings, and written correspondence, between Trusts, BSO and agencies in relation to the delay in issuing backpay to all agency workers affected, since the March 4th letter was issued.

Dear FOI BSO,

On 28 May 2021 I asked a series of question which required SPEC IFICS in their answrers.

BSO has ignores the request for sepcificity and sent various phrases and attachments which in no way shape or form answers the questions asked on 28 May 2021.

Namely the line,
"BSO PaLS is not responsible for the rates of pay agreed. The BSO will provide no further comment. " is of partricular uselessness and overtly chooses to ignore the questions asked, which are in the public interest. Repeating lines from a previous FOI resppnse does not answer the questions made on 28 May.
I am therefore requesting an Internal Review
