Dear Colchester Hospital University NHS Foundation Trust,

I am writing with a request under the Freedom of Information Act. I would like this information for the calendar year to date, 2017, 2016, 2015, 2014 and 2013.

Please can you tell me:

*How many people working at the trust have been subject to disciplinary proceedings for their use of instant messaging apps (e.g. WhatsApp, Facebook Messenger, Snapchat)?

*How many people working at the trust have been subject to disciplinary proceedings for their use of social media (e.g. Facebook, Twitter, Instagram)?

*Please tell me, for each case, the job title of the staff member concerned (e.g. junior doctor, consultant, nurse, administrative staff) and which sanctions were applied (e.g. dismissal, formal warning, referral to professional regulator).

I would prefer to receive the information electronically, and in either Excel or CSV format.

Should this request be likely to breach the costs limit set out in section 12 of the FOI Act, I would like the information for the most recent calendar years in turn, going backwards until the cost limit is reached.

Further to your request made to Colchester Hospital University NHS
Foundation Trust for information relating to the above and pursuant to the
Freedom of Information Act 2000, please see the Trust’s response below.

 

You requested:

 

I am writing with a request under the Freedom of Information Act. I would
like this information for the calendar year to date, 2017, 2016, 2015,
2014 and 2013.

 

Please can you tell me:

 

*How many people working at the trust have been subject to disciplinary
proceedings for their use of instant messaging apps (e.g. WhatsApp,

Due to the low number of cases received per year, to answer the above
questions broken down in the way requested would give person identifiable
data. However, I can confirm that a total of 10 staff have been subject to
disciplinary proceedings for the use of instant messaging and social media
apps between 2013 - 2017.

 

This figure consists of the following staff groups:

 

Medical and Dental

Non Clinical

Nursing and Midwifery

 

The information you have requested is classed as personal information by
the Data Protection Act 1998, as it is possible to identify an individual
from that data. After due consideration, the Trust has applied an
exemption from disclosure under Section 40(2) (personal information) of
the Freedom of Information Act as to release all the information you have
requested would be a breach of the Data Protection principles. After
considering the public interest in releasing this data, the Trust feels
that there is not a legitimate reason to do so.
