3. where any body corporate (such as, for example, a charity) was involved in the creation of the scheme, the name of the body corporate and particulars of the extent of its involvement

4. contact details of the lead officer of the local authority who deals with compliance with the disability equality duty, including name, address, telephone number, and email address

5. a copy of your plans to comply with the duty to
eliminate harassment against disabled people

of the Freedom of Information Act 2000, Ref No FOI/10/333.

1. A copy of your current disability equality scheme;

Chorley Council's current equality scheme can be found online at

I therefore refuse your request for a copy of the Council's current
disability equality scheme, on the grounds that the information is
reasonably accessible by other means, under Section 21 of the Freedom of
Information Act 2000. This is an absolute exemption; therefore the Public
Interest test has not been implemented.

2. Details of the steps taken to involve disabled people in creating
the scheme.

Chorley Council has worked closely with the Chorley and South Ribble
Disability forum in creating the scheme

3. Where any body corporate (such as, for example, a charity) was
involved in the creation of the scheme, the name of the body corporate and
particulars of the extent of its involvement

The Council's plans to comply with its duty to eliminate harassment
against disabled people forms part of the Equality Scheme. It is also
reflected in the "Equality and Diversity in Employment Policy" and links
into the Council's Customer Services Function. I have attached a copy of
this policy for your information

I am writing to request an internal review of Chorley Borough Council's handling of my FOI request 'Disability Equality Scheme'.

Although, I am grateful to have received a response, I requested a copy of the current disability equality scheme, 2010 - 2011, and have only been provided with a copy of the 2008 - 2009 scheme. Is it therefore, a current scheme does not exist?

I thank you in advance for your assistance with this matter and I look forward to hearing from you.

Thanks you for your email requesting an Internal Review of the
response given to your request for information under the terms of the
Freedom of Information Act 2000, Ref No FOI/10/333

The Council's current Equality Scheme is the document that you were
supplied with via our website.

However, it is due to be refreshed in Jan / Feb 2011, following final
publication of the rest of the Equality Act. Amendments to internal
processes have already been made following the October part ot the
Equality Act.

This new Equality Scheme will be published on the Council website in due
course.

Given this information, can you please confirm whether or not you wish to
proceed with a request for an Internal Review.
