On the 30 December 2009, the questions had been addressed as follows :

A2) The Council does not pay Direct Payments for care of relatives

A3) Maximum care home payment for an individual is £1,865.01 per week.
This is the SSD contribution only and excludes client's contribution.

A4) Maximum nursing home payment for an individual is £1,745.52 per week. This is the SSD contribution only and excludes client's contributions.

The Council’s response is set out below:

 

A1) The maximum weekly amount paid by BMDC to an individual is £3,296.
Figures are inclusive of Adult Social Care costs and do not include any
client contributions.

 

A2) Data on the relationship between carers and those in receipt of care
is not routinely recorded. 

 

Section 12 of the Freedom of Information Act makes provision for the
Council to refuse requests for information where the cost of dealing with
them would exceed the appropriate limit, which for Local Authorities is
set at £450. This represents the estimated cost of one person spending
more than 18 hours in determining whether the Service holds the
information, locating, retrieving and extracting the information.

 

There are over 1300 records which would need to be located and reviewed,
allowing 15 minutes per record would require over 325 hours of officer
time.  In accordance with Section 17(1) of the Freedom of Information Act,
this response acts as a refusal notice under the provisions of Section 12
of the Act as the Council estimates that to comply with your request in
its current form will exceed the appropriate limit.

 

A3) Maximum care home payment for an individual is £4768 per week. Figures
are inclusive of Adult Social Care costs and do not include any client
contributions.

 

A4) Maximum nursing home payment for an individual is £2,509 per week.
Figures are inclusive of Adult Social Care costs and do not include any
client contributions.

 

In accordance with the Freedom of Information Act, if you are not

My internal review request specifically refers to Question 2, where you have looked to rely on a section 12 exemption.

Q2) What is the maximum weekly amount paid by Bradford Metropolitan District Council to any individual under the Direct Payment scheme for the care of a relative?

A2) The Council does not pay Direct Payments for care of relatives.

On the 6th of July 2023, you have applied section 12 as follows :

"A2) Data on the relationship between carers and those in receipt of care is not routinely recorded.

My internal review request specifically refers to Question 2, where you
have looked to rely on a section 12 exemption.

Q2) What is the maximum weekly amount paid by Bradford Metropolitan
District Council to any individual under the Direct Payment scheme for the
care of a relative?

A2) The Council does not pay Direct Payments for care of relatives.

On the 6th of July 2023, you have applied section 12 as follows :

"A2) Data on the relationship between carers and those in receipt of care
is not routinely recorded.

Section 12 of the Freedom of Information Act makes provision for the
Council to refuse requests for information where the cost of dealing with
them would exceed the appropriate limit, which for Local Authorities is
set at £450. This represents the estimated cost of one person spending
more than 18 hours in determining whether the Service holds the
information, locating, retrieving and extracting the information.

There are over 1300 records which would need to be located and reviewed,
allowing 15 minutes per record would require over 325 hours of officer
time. In accordance with Section 17(1) of the Freedom of Information Act,
this response acts as a refusal notice under the provisions of Section 12
of the Act as the Council estimates that to comply with your request in
its current form will exceed the appropriate limit."

Question : How an you apply a cost exemption on information you state you
do not hold?

Thank you for your email dated 18 August 2023, requesting a review of the
decision made under the Freedom of Information Act 2000.

 

I have considered the information presented to me and I can confirm, by
way of explanation, that data on the relationship between carers and those
in receipt of care may be detailed within Support Plans or case notes
within our system, but it is not a recording requirement and is not
routinely recorded in a standard way.

 

To identify if we hold this information and to calculate weekly amounts
would involve the review of approximately 1300 cases at 15 minutes per
case requiring over 325 hours of officer time, more than the appropriate
limit of 18 hours.

Dear ICO - Paula Flanagan,

I write to lodge a new complaint to yourself as the Information Commissioner's Office (ICO) regarding the City of Bradford Metropolitan District Council's (CBMDC) handling of my FOI request via the WhatDoTheyKnow website. See the following :

Since December 2009, the Local Authority (LA) CBMDC's position to the following question has been :

"Q2) What is the maximum weekly amount paid by Bradford Metropolitan District Council to any individual under the Direct Payment scheme for the care of a relative?

A2) The Council does not pay Direct Payments for care of relatives."

In June 2023, I looked to revise this very same question as part of my FOI request for an update to the current year, with the following FOI

" Please can you kindly update your 2009 answers to these questions with figures for the financial year ending in 2023."

On the 6th of July 2023, the LA applied a section 12 exemption in reply to question two.

"A2) Data on the relationship between carers and those in receipt of care is not routinely recorded. "

However, this seems to be now a reply to an altogether different question. At first, they stated "they do not pay Direct Payment for the care of relatives" then they changed the goalpost to state "they do not record the relationship between the carer and recipient of care", and in order to determine this relationship they would need to go through over 1,300 records, thus exceeding the cost limitation under section 12. However, since they had already stated they do not pay relatives Direct Payments they would not gain anything by reviewing the 1,300 records to establish the carer and care recipient relationship, as this would simply be an exercise in futility.

I believe the use of Section 12 in reply to an altogether different question is a deliberate contrivance to obfuscate and discombobulate the clarity of understanding required, by deliberately muddying the waters, so to speak. We have gone from a clear-cut definitive answer to a position of where the answer can not be reached due to cost limitations. This, I feel is disingenuous and a completely unacceptable position for the Local Authority to now take.

If the LA does not pay Direct Payments for the care of relatives, as they have stated since 2009, then why would they need to review the records when I have asked for the latest update? Unless their policy had subsequently changed over the intervening years and now they do pay Direct Payment for the care of relatives but they simply don't record this fact in a meaningful way for statistical purposes in reply to any FOI requests. If this is the case then this opens the next reasonable question of when had this policy change taken place to now pay Direct Payments for the care of relatives, rather than for them to start reviewing records to establish the carer and care recipient relationship.

This question was focused on the LA's policy regarding Direct Payments, rather than on the qualitative information of the carer and care recipient relationship.

Please can you look to fully investigate this complaint to see the nuanced sleight of hand being deployed here by the LA to deliberately equivocate on the responses given?
