Dear Mr Reeves

 

I refer to your email requesting an internal review of a freedom of
information request you submitted in relation to Dinamo Animation.

 

As the Service Director for Legal and Democratic Services it falls to me
to consider such matters where a request has been made to review how the
freedom of information request was originally handled.

 

Firstly, I would like to apologise for the delay in the requested
information reaching you. It is always the Authority's intention to comply
with the statutory timescales laid down in the Freedom of Information Act
and provide the Authority's response within the 20 day working day period
and regrettably, on this occasion, we fell short of this target.

 

Having considered and reviewed your request, unfortunately, I am unable to
release all of the information that you have requested as I consider
certain information to be exempt under Section 43 of the Freedom of
Information Act which deals with prejudice to commercial interests.  This
is a qualified exemption and I have therefore applied the public interest
test. In making this decision I have weighed such factors as the Council's
desire to be open and transparent in all its dealings against the need to
ensure that it is able to contract openly in the market place and also to
protect the commercial interests of those companies and bodies it deals
with.

 

I am also applying the exemption under section 40 (personal information)
as some of the information constitutes third party data.  Section 40(2)
provides that personal data about third parties is exempt information if
one of the conditions set out in section 40(3) is satisfied.  Under the
Act disclosure of this information would breach the fair processing
principle contained in the Data Protection Act (DPA), where it would be
unfair to that person/is confidential. 

 

Accordingly, insofar as this element of your request is concerned and in
accordance with Section 17 of the Freedom of Information Act 2000 ("the
Act") this e-mail acts as a Refusal Notice.

 

However, I have attached a copy of the grant offer letter, which contains
the terms and conditions of the Local Investment Fund.  These have been
developed in conjunction with the Welsh European Funding Office (the Welsh
Government Body responsible for administering all European Funds in Wales)
Guidelines.  The grant application in question has been administered in
accordance with these terms and conditions.

 

There are strict audit requirements attached to publicly administered
funds, including our European Funded Local Investment Fund Grant
Programme. All applications are closely scrutinised by Council Officers
during the grant application process and is subject to further scrutiny by
independent external auditors (Welsh Audit Office), to ensure that grants
have been awarded and administered in accordance with EU funding
guidelines.
