REF: Freedom of Information request - Determining Officers Avoncliff
2012-2014    140224/DJ03  & 140305/EW01

Thank you for your request for information dated 21 February 2014, which
asks for the names of the determining officers and their direct
supervisors in the recent determination of licences at Avoncliff, and also
for the name of the ‘Head of Water Licensing’.

 

Requests for information are generally governed by the Freedom of
Information Act 2000 (FoIA).  The information you have requested is
‘environmental’ and as such, it is exempted from the provisions of FoIA by
FoIA section 39(1).  We have therefore considered your request under the
provisions of the Environmental Information Regulations 2004 (EIR). 
Regulation 12(3) of the EIR requires that a public authority does not
disclose environmental information if it is ‘personal information’ and it
is excepted from disclosure under Regulation 13.

 

When assessing whether personal information is excepted from disclosure,
we consider the expectations of the individuals to whom the information
relates.  When individuals are public authority employees in a senior or a
public facing role, or key decision makers, there is an expectation that
their names will be made publicly available.  We also consider whether it
is possible to meet the legitimate public interest without disclosing
names, whether the identity of an officer provides any greater
understanding of the decision making processes in the Agency and whether
there are any other factors that create an overriding right to privacy.

 

After applying all the above considerations we confirm that the Avoncliff
licence determination was authorised on behalf of the Environment Agency
by Steve Jackson, National Permitting Service Manager. Steve Jackson was
assisted by other officers for example John Sweeney, National Permitting
Service, Nottingham Centre Manager. The Agency does not have a position
called ‘Head of Water Licensing’.

 

In relation to this permit application, we consider that officers who are
not in a senior or public facing role, and are not key decision makers,
have a higher expectation of privacy and do not expect that their names
will be made available to the world at large.  After balancing any public
interest factors in favour of disclosure against the right to privacy,  we
consider that that there is no overriding public interest, and we  refuse
to supply the names of other officers under Regulation 13 of the EIR.

 

Regulation 13 states:

(1)    To the extent that the information requested includes personal data
... and the first or second condition below is satisfied, a public
authority shall not disclose the personal data.

(2)    The first condition is

(a)    ... that the disclosure of the information to a member of the
public otherwise than under these regulations would contravene-

(i)                  any of the data protection principles...

We consider that disclosure of the names of officers who are not senior,
public facing or key decision makers would breach the first data
protection principle.  This requires that all disclosures of personal
information be fair and lawful. 

 

Rights of appeal 

 

If you are not satisfied with response, you can contact us to ask for our
decision to be reviewed.  If you are still not satisfied following this,
you can then make an appeal to the Information Commissioner, who is the
