Dear Pensions Ombudsman,

I am trying to search for past Pensions Ombudsman determinations relating to cases against the Pension Protection Fund regarding the Pension Protection Fund levy.

However, I am finding that the search function at https://www.pensions-ombudsman.org.uk/ou... is malfunctioning – I can enter “pension protection fund” in the field but I get a lot of results (over 900 in total), many of which have nothing to do with the Pension Protection Fund. If I try to use the filters – e.g. by year – no results are returned at all.

If I try to search for words specifically relevant to the Pension Protection Fund levy (e.g. "Experian", "Mean Score", "Levy Band", "levy rate"), either no results are returned, or many results are returned which are not relevant. This is despite the Pensions Ombudsman being the relevant Ombudsman appointed to deal with complaints that have not been upheld by the PPF's Reconsideration Committee.

Please can you provide me with a full and complete set of determinations regarding past Pensions Ombudsman determinations relating to cases against the Pension Protection Fund regarding the Pension Protection Fund levy.

Thank you for your enquiry regarding determinations relating to cases
against the Pension Protection Fund.

 

On the left hand side of the ‘Our decisions’ page, there is a drop down
menu under ‘Decision type’.  From here you should be able to select ‘PPF
referral’ or ‘PPF complaint’ which should bring up the results you are
looking for.  You can then further refine the results by entering a
keyword.  I have put here the links to the search results.

Thank you for your reply.

The crux of my issue is that the search facility provided on your website is providing a lot of irrelevant cases and does not provide the information I am seeing.

Unfortunately, some of the links provided in your response provide cases that are not at all related to the Pension Protection Fund levy - an example being the search "PPF complaint":

As such, your response may have not provided the information requested.

To shed light on whether there are any cases missing, please could you also provide the following information under this Freedom of Information Act request:

- the number of cases referred to the Pensions Ombudsman regarding appeals of the risk-based element of the Pension Protection Fund levy, broken down by levy year. Please can this cover every levy year since 2006/07 inclusive.

- an electronic copy of the Pension Ombudsman's determination for each case.

I apologise for the delay in getting back to you.

Our case management system can only provide details going back to 2012. In
addition our system does not specifically track decisions relating to the
risk-based element of the Pension Protection Fund levy.

Any cases in relation to the risk-based element of the Pension Protection
Fund levy would be categorised as 'PPF reviewable matters' within our case
management system.

Since 2012 we have dealt with 74 complaints categorised under 'PPF
reviewable matters'. Of these 74 cases, 28 were determined by an
Ombudsman.

17 of the 28 determinations have been published on our website. I have
been through those determinations and can confirm that the following cases
relate to the risk-based element of the Pension Protection Fund levy. I
have listed the reference numbers below. I am unable to provide you with
the unpublished determinations.
