Details on operating of A38/A380 average speed cameras

Could you please provide me some details about the operation of the average speed cameras on the A38 and A380 in the area of Haldon Hill/Splatford Split/Wobbly Wheel.

Specifically, could you please provide details on:
(1) How long (i) images and (ii) vehicle details (such as a record of the VRM) are kept, if no offence is recorded by the cameras
(2) Whether details of any vehicles not identified as having committed an speed offence are shared with any other agency
(3) If the cameras monitor (directly, or indirectly through a partner agency) any offences other than speed
(4) If the vehicle speed limit is calculated based on the classification of the vehicle (i.e. panel van, light goods vehicle, car), or set to a blanket speed

I refer to your request for an internal review on the 15 February in relation to your initial request submitted on 14 December 2017. I have investigated your complaint and have found that due to an administrative error, your query was not forwarded onto the correct business area. I sincerely apologise for the error and the delay this has caused you in receiving a response from us.

Your request asked for the following information:

With regards to question 4, I can confirm that the cameras enforce the national speed limit at this point on the road

Dear Highways England Company Limited,

I acknowledge your reply, however I do not believe that you are necessarily complying with the terms of the FOIA.

My question is whether you hold this information, and that does not necessarily mean that you are the enforcement authority.

It is difficult to treat as credible any claim that on a road you manage, and where your project manager is quoted in all the relevant press, and where you are a partner in the safety camera partnership operating the scheme, that you do not hold the information, even if you are not the lead agency.

This seems to be a case of trying to quickly push an answer out, pushing the responsibility to another agency.

I would ask that you look at this once again.

Thank you for your email dated 19 March. I can confirm, as per my previous email, that we do not hold the information in relation to your request on average speed cameras

Speed enforcement cameras, known as HADECS 3 are linked to the electronic signals which show mandatory speed limits. Highways England owns and installs the HADECS cameras and the enforcement authority e.g. the local police constabulary are responsible for operating them and carrying out enforcement. As Highways England have no purpose in holding the recorded data (as we are not the enforcement authority) the information is not held by us. Therefore, as per my previous email, you will need to direct your enquiry to Devon and Cornwall Police

If you are not content with the outcome of the internal review, you have the right to apply directly to the Information Commissioner for a decision. The Information Commissioner can be contacted at:
