Please can you provide us with any information you hold on these nineteen Organised Crime Groups such as:-
• Their names
• The regions they operate in
• The types of crimes they are involved in
• Any links they have to other UK or Worldwide Organised Crime/Terrorist groups

Thank you for your request for information dated and received by the
Freedom of Information Unit on 19/06/2019 concerning Organised Crime
Groups active within Dyfed-Powys Police Force area.

 

This request is being handled under the Freedom of Information Act 2000.

 

Dyfed-Powys Police can confirm that it does hold some of the information
covered by your request; however we believe that we need further time in
which to provide a full response to you.

 

We consider that the following exemption of the Freedom of Information Act
may apply to the information in part:

 

Section 31(1)(a)(b) Law Enforcement

 

(1)    Information which is not exempt information by virtue of section 30
is exempt information if its disclosure under this Act would, or would be
likely to prejudice â

(a)    The prevention or detection of crime

(b)    The apprehension or prosecution of offenders

 

Sections 31 is a prejudiced-based qualified exemption and there is a
requirement to articulate the harm that would be caused by disclosing the
information, as well as carrying out a public interest test in order to
establish whether the public interest in maintaining the exemption may be
outweighed by a wider public benefit in disclosure.

 

 

We now need further time in which to consider the public interest in
disclosing the information. We will endeavour to provide you with a
response as soon as possible and in any case by 14/08/2019. Should there
be any further delay we will write to you accordingly.

on 19/06/2019 regarding Organised Crime Groups.

This request is being handled under the Freedom of Information Act 2000.

It is with regret that I have to inform you that the 20 working day
deadline (14/08/2019) under section 10 of The Freedom of Information Act
in respect of this request has not been met, due to difficulties in
retrieving and collating the relevant requested information or delays in
the FOI process.

On behalf of Dyfed-Powys Police I would like to apologise for not
complying with this legal requirement in respect of this matter as well as
for any inconvenience this may have caused.

However your request for information, which is continuing to be processed,
will be completed as soon as possible.

I write in connection with your request for information dated and received
in the Freedom of Information Unit at Dyfed-Powys Police on 19/06/19
regarding Organised Crime Groups.

 

Your request for information has been handled under the Freedom of
Information Act 2000 and has now been considered.

 

Section 1 of the Freedom of Information Act 2000 places two duties on
public authorities. Unless exemptions apply, the first duty at Section
1(1) (a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1) (b) is to disclose
information that has been confirmed as being held.

 

I can confirm that Dyfed-Powys Police does hold the information you have
requested. However we are withholding that information since we consider
that the following exemptions apply:

 

Section 24(1) - National Security

Section 31(1)(a)(b) - Law Enforcement 

Section 38(1)(a)(b) - Health & Safety

Section 40(2) - Personal Information

 

Additionally Dyfed-Powys Police can neither confirm nor deny that it holds
any other information relative to your request as the duty in Section
1(1)(a) of the Freedom of Information Act 2000 does not apply by virtue of
the following exemption:

 

Section 23(5) Information supplied by or concerning exempt bodies

 

Please see the attached response document which details the harm and
public interest test relative to the application of the exemptions which
in all the circumstances of the case, the public interest in maintaining
the exemptions outweighs the public interest in disclosing the
information.
