Please can you give full details of the soundings taken from the Council as detailed by the Chair within point 9.1 of the minutes of the council meeting on 13th may 2020, relating to the reported unanimous view that Annual Retention Fee should not be revisited.

Please can this information include the names of said council members, the full written communication both to them and received from them regarding this matter, as referred to above.

Regarding point 10. Please can you give full details of the decision making process that has led to the Council decision to use the staff payroll budget to top up furloughed staff salaries to 80% of their usual salary amounts, when above the government cap.

Further more, please give full details of the month by month expenditure for this purpose that has been taken directly from the staff payroll budget. in addition, please give details, which can be suitably anonymised, of the exact excess payments for each staff member affected, also on a month by month basis.

Dear General Dental Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of General Dental Council's handling of my FOI request 'Details of soundings taken from the Council by correspondence, point 9.1, and also details pertaining to point 10, minutes Council meeting 13/05/2020.'.

Regarding your detailed explanation for the reasons for withholding the information I requested, I do not accept the following tenets of your argument:

1 - That the council, on this occasion, require a confidential or "safe" space to consider and provide advice, discuss options and provide views. The nature of the ARF, its absolute central position as the financial basis for the continued operational capabilities of the GDC, and the extremely controversial recent actions, or lack of actions, regarding it, mean that the public need to know and requirement for full and complete disclosure, far outweighs any requirement for secrecy on this occasion.

2 - The GDC's Chief Executive is not best placed to provide a truly objective view of this decision, as the CEO is accountable for the liquidity of the GDC with regard to its financials, he thus has an inherent conflict of interest between that key personal performance indicator, and the need for an entirely objective decision here.

3 - Your weighing of the public interest during the COVID-19 crisis, and enhancing the transparency of the GDC at the current time, against your disclosure of abridged minutes and the "Chair's blog", is inherently flawed. it fails to take into the account the very nature of transparency when a decision that will materially affect the wellbeing of an entire profession during an emergency of unique proportions is occurring, and shows a worrying lack of appreciation for the need for your council members to be entirely open to scrutiny when deciding to affect the financial wellbeing of your registrants, even more so when you have a surfeit of funds at your disposal.

4 - It is clear from the lengthy delay between my FOI, and my receipt of this rather disappointing missive, that your legally sought opinion has been complex and has not come down strongly on the side of secrecy. I would expect that this formal internal review revisits this and does the right thing. A full and candid disclosure is required.
