I can confirm that Highlands and Islands Enterprise (HIE) have dealt
directly with just Lockheed Martin and Orbex (Orbital Express Launch Ltd)
over the period from 30 January 2020 to 1 October 2020.

 

I have attached (See PDF above) a listing of dates of all meetings between
HIE and the two companies, the purpose of each meeting is also listed,
this is our most secure readable format for release.   

 

(Please note that names of meeting participants have been withheld in
accordance with Section 38(1) (b) in conjunction with 38 (2A) (a) of
FOISA. This is because the information constitutes personal data under
data protection legislation and to disclose the information would breach
one or more of the data protection principles).

I am writing to request an internal review of Highlands and Islands Enterprise's handling of my FOI request 'Details of meetings between HIE, Lockheed Martin, Orbex, Raytheon & Leonardo'.

On 11/12/2020 I submitted a Freedom of Information Request regarding the 'Details of meetings between HIE, Lockheed Martin, Orbex, Raytheon & Leonardo'. On 13/01/2021 I received a response detailing the dates of meetings between HIE, Lockheed Martin & Orbex (Orbital Express Launch Limited).

However, I had also requested information regarding:
-Any meeting minutes & materials (Such as powerpoint presentations).
-All correspondence regarding specified meetings (Sent via email, Whatsapp,
Slack, Yammer etc)

In your response on 13/01/2021 it was stated that:

"With regard to the specific request for relevant recorded information (including meeting minutes and materials and correspondence) from 30 January 2020 to 1 October 2020 we are currently preparing these for
disclosure, we do however require to consult with Third Parties on much of this information and therefore apologise for not being in a position to provide this additional information with this response.

However, I am still awaiting details of all relevant recorded information and I have not had any response from HIE since the 13/01/2021. Therefore, I am writing to request an internal review of Highlands and Islands Enterprise's handling of my FOI request 'Details of meetings between HIE, Lockheed Martin, Orbex, Raytheon & Leonardo'.

As you are aware we previously responded in part to your request on 13
January 2021, however with regard to the element of your request asking
for ‘relevant recorded information (including meeting minutes and
materials and correspondence) from 30 January 2020 to 1 October 2020’, we
indicated to you that the relevant information would be forwarded to you
in due course.  We once again sincerely apologise for the delay in
providing you with this information.

 

I can confirm that Highlands and Islands Enterprise (HIE) have dealt
directly with just Lockheed Martin and Orbex (Orbital Express Launch Ltd)
over the period from 30 January 2020 to 1 October 2020.

 

I have attached (See PDF above) the relevant recorded information that HIE
holds relating to individual meetings between Highland and Islands
Enterprise and in this case Orbex (Orbital Express Launch Ltd) over the
period from 30 January 2020 to 1 October 2020. (In accordance with section
17 of the Freedom of Information (Scotland) Act 2002 (FOISA), we do not
hold any meeting information in relation to Lockheed Martin over this
period of time).

 

Please note that information has been withheld under the health and safety
exemption s39(1) of FOISA as it has been decided that disclosure would
compromise safety.  Information has also been withheld under Section
33(1)(b) Commercial interests and the economy, as it is considered that
disclosure would, or would be likely to, substantially prejudice the
commercial interests of both Orbex and HIE. 

 

Finally information is also being withheld under Section 30(c) the
Effective conduct of public affairs under FOISA as disclosure would
undermine confidence in commercial working relationships HIE needs to
establish and maintain with its client. 

 

 

Public Interest.

 

The use of the above three exemptions requires HIE to consider the public
interest and in this case, it has been decided the public interest is in
withholding some of the information.  It is essential that HIE does not
prejudice substantially the position of Orbex by disclosing information
which could be both a danger to the physical health and safety of an
individual.  In this context “safety” refers to a person’s wellbeing as
well as the real potential risk to site and system security. It is also
clear that HIE should continue to be in a position where its working
relationship with clients is not impeded nor undermined through the
disclosure of commercial information.

 

Finally in addition to the above personal information has been withheld in
accordance with Section 38(1) (b) in conjunction with 38 (2A) (a) of
FOISA. (This is because the information constitutes personal data under
data protection legislation and to disclose the information would breach
one or more of the data protection principles).  This is an absolute
exemption and does not require consideration of the public interest.

 

I note that you have recently requested a review (1 March 2021) on the
basis that you have yet to receive the information we are now releasing,
please could you now confirm whether you would like to proceed with the
review?  If we don’t hear from you by 8 March 2021 we will proceed with
processing your request.
