Details of Dealing with Polychlorinated BiPhenyls during GEC Demolition

Waiting for an internal review by Thanet District Council of their handling of this request.

Dear Thanet District Council,

During demolition of the former GEC factory Westwood, Kent Fire Brigade attendance was reportedly suspended upon discovery of polychlorinated biphenyls.

What action was taken to investigate the site, collate the pre-existing Boilermakers Union Reports of Concern, liaise with Kent County Council (Whose landfill tests found PCBs surfacing at Pegwell), report to Environment Agency and remediate site.

Please disclose records your GEC site records (Public Right to Know Aarhus Convention) Also what action TDC took to list site as subject of United Nations Stockholm Convention on persistent organic pollutants. Also your reports to Southern Water Authority re implications for Rumfields Water supply aquifer. And your reports to direct abstraction licensees K Laundry and Newlands Farm.

I understand GMBU (Boilermakers) are currently in touch with TDC. Please take the opportunity to clarify GMBU reporting of polychlorinated biphenyls Westwood and Pegwell.

If they have records you can derive initial toxic load (Environmental Protection Act 1990)

Dear TDC FOI,

You are overdue to answer this completely new FOI, based on new information, which pertains to your duties re permitted development (Non existent right ) re Bretts Ramsgate. I have explored the situation to your CEO so she understands exactly. It also pertains to maternity tragedies inquiry at QEQM Hospital and research the inquiry has scheduled having made me witness status.

I know of late TDC FOI you have taken to inventing FOIs , atttributing them to me and attempting to change FOI answers to which you already committed. But to clarify, the idea is that I ask a question in the public interest and then you answer it in the public interest.

The response to your request is set out below.
TDC response to FOI 4100:
The Council has treated this request under the Environmental Information
Regulations (EIR) 2004. The Council refuses your request under regulation
12(4)(b) of those regulations as it considers your request to be
manifestly unreasonable.
Regulation 12(4)(b) states that for the purposes of paragraph (1)(a), a
public authority may refuse to disclose information to the extent that –
(b) the request for information is manifestly unreasonable.

When considering whether a request is ‘manifestly unreasonable’ under
regulation 12(4)(b) of the EIR, the Information Commissioner's Office
(ICO) recommends that we consider requests under similar criteria to those
under Section 14 of the Freedom of Information Act 2000 (FOIA), “vexatious
requests”. Section 14(1) states that a public authority is not obliged
to comply with a request for information if the request is vexatious. We
have taken into account ICO guidance on vexatious requests which can be

I am writing to request an internal review of Thanet District Council's handling of my FOI request 'Details of Dealing with Polychlorinated BiPhenyls during GEC Demolition'.

Please answer the following tests

(1) Was it "Manifestly unreasonable" of Dr Steve Ladyman MP TDC to ask about this matter in 2009.

(2) Did you answer Dr Steve Ladyman MP question ?

For public record I point out that in 2009 TDC was enetering lease agreement with BRETTS at Ramsgate Port

In 2009 Dr Chandrakumar called for adverse health impact epidemiology Inquiry re SERICOL hundreds of tonnes of cyclohexanone leaked into water supply aquifer. If this inquiry had proceeded Dr Ladyman's question re polychlorinated biphenyls would have transferred to the Health Protection Agency EXPERTS.

And epidemiology inquiry would have occurred two years after DEFRA DWI issued water supply PFOA warnings. And at time new Public Health England issued further PFOA water supply warnings that of course pertain to your duties to BRETTS as landlord and planning authority (Condemning a concrete plant to unwittlingly use contaminated water supply)

(3) If this same FOI is made now by an elected Cllr would it be manifestly unreasonable in your anxiety to conceal the answer ?

I understand your anxiety to impress TDC Corporate Management Team with your recent graduate virtuosity in inventing non existent FOIs in order to try to change answers TDC is already committed to. And you appear to be addicted now to "Manifestly unreasonable" as a quasi excuse to conceal facts from the public.

What Remediation action for PCBs was made at GEC demolition site ? Am I correct that superfical surface removal occurred without any tests for source of ground surfacing highly toxic highly persistent PCBs ?

Do you think it is evan remotely rational of you to believe the public should forego these answers because telling the truth might hurt TDC feelings ?
