Details of advertising consent for new signs at Manningtree Station

Dear Tendring District Council,

A new regime of parking enforcement has been initiated at Manningtree Station. As part of that new regime Automatic Number Plate Recognition (ANPR) cameras have been installed apparently without planning permission on the approach road to Manningtree Station by National Car Parks (NCP) &/or Greater Anglia. The whole approach road to Manningtree Station now appears to be designated a car park & there is a large sign at the entrance & further signs along the road to the station. Please can you provide details of Advertising Consent submitted for these signs & the decision of the Council.

confirm that your enquiry is receiving attention.

 

In accordance with the provisions of the Freedom of Information Act 2000

unless the Council does not hold the information or there is a reason for
it to be withheld.

Dear Mr Barker,

 

Further to your FOI request regarding advertising consent for signs at
Manningtree Station, which was received on 21/03/19, please be advised
that there has been no Advertisement Consent application submitted for the
signage that you refer to in your enquiry.

 

However, after consulting with the relevant services, we can confirm that
the approach road to the station is owned by Abellio East Anglia Ltd,
therefore it is not a road maintainable at public expense, it is and would
be deemed a private road / forecourt area of the station.  I am informed
that, under Class 6 (Advertisements on Business Forecourts) of the
Advertisement Regulations, they do have deemed consent to erect signage
without obtaining advertisement consent.  Class1 (Functional
Advertisements by Public Bodies) of the same Regulations, also permits
such signage. Additionally, there are Advertisements which are Excluded
from Direct Control, these specifically include advertisements displayed
on enclosed land namely; railway station forecourts.

 

I am further advised that there are many exemptions under the
Advertisement Regulations which they could legitimately have relied upon
to demonstrate why they have not applied for permission. In order to  take
any enforcement action the Council is required to demonstrate that a
breach caused significant loss, harm or injury to the public generally.
The signs are displayed for a legitimate lawful reason; to inform, warn
and advise users of parking restrictions within the precinct of the
railway station. They therefore serve a lawful purpose and cause no harm,
loss or injury to anyone going about their lawful daily life.

 

I hope this information is of assistance to you. However if you feel that
