Details of a prosecution

We're waiting for Ms Lee to read recent responses and update the status.

Dear Crown Prosecution Service

The CPS instructed barrister Graeme Molloy of 9 King's Bench Walk chambers to prosecute an ex-headmaster of Stowe school who was charged with the sexual assault of a child on the tube system. This would not have been earlier than 2012, and possibly - although not certainly - happened about two or three years ago: say, circa 2016/2017.

I should like the details of this Case, and the resulting Prosecution, including:

(1) The name of the CPS official(s) who was/were the lead individual(s) responsible for assembling the case against the ex-headmaster.

(2) The date on which the CPS instructed Mr Molloy to prosecute the ex-headmaster.

(3) Confirmation of the subject of the prosecution: defendant's name, date of birth, sex & nationality.

(4) The dates of the trial (start & end dates).

(5) The location of the trial.

(6) The name of the presiding judge or magistrate.

(7) Confirmation as to whether this was a jury trial.

(8) The legal charge(s) against the ex-headmaster.

(9) A summary of the evidence against the ex-headmaster. Additionally, if applicable, the factors proffered by the CPS as adjudged by the CPS to be aggravating or mitigating.

(10) The name & location of the tube station(s), and/or other location(s), where the alleged offence(s) were alleged to have been committed.

(11) Confirmation as to whether the alleged offence(s) took place on board a tube train(s); or, if not, where they took place (e.g. platform x of x station, by the entrance of x station, etc.).

(12) The exact date(s), and approximate time(s), that the alleged offence(s) were said to have been committed.

(13) Confirmation as to whether bystanders were present on the applicable train(s) or station(s) when the alleged offences occurred.

(14) Confirmation as to whether there was/were a known witness, or witnesses, to each of the alleged offence(s) besides the alleged victim.

(15) Confirmation as to whether CCTV footage, or reference to the existence of it, was included in the CPS file on the ex-headmaster. Also, what any such footage consisted of.

(16) In the case of each alleged offence: Confirmation as to whether any witness, or witnesses, were members of the public, or public transport staff, or 'Other' (e.g. British Transport Police, Metropolitan Police, City of London Police, Thames Valley Police, etc).

(17) On what date and to which police service was/were the complaint(s) originally lodged.

(18) Confirmation as to with whom the complaint(s) that ultimately resulted in the CPS preparing this case originated. Did the complaint(s) originate with the alleged victim, the alleged victim's parent or caretaker, or another party (please specify their relationship to the alleged victim).

(19) The age, sex & nationality of the alleged victim at the time the alleged offence(s) occurred.

(20) Confirmation as to whether the alleged victim gave evidence at the trial.

(21) Confirmation as to whether the alleged victim was accompanied or travelling alone when the alleged offence(s) occurred.

(22) Confirmation as to whether the ex-headmaster had a pre-existing criminal record; and/or police caution(s); and/or a preexisting CPS file; and/or was known to the CPS prior to the alleged offence(s) on the tube system (including in connection with other cases, if applicable).

(23) The result of the prosecution.

(24) Confirmation as to whether or not the CPS appealed the court judgement, if applicable.

(24) A summary of the CPS' rationale for appealing or not appealing the court judgement.

(25) The judge/magistrate's verdict, including his or her summary of the findings & rationale for his or her decision.

(26) If a jury trial: How many jurors supported the trial verdict & how many did not.

(27) Confirmation as to whether the CPS maintain an active or open file on, or continued interest in, the ex-headmaster. The reason for this active or open file or continued interest in the ex-headmaster, if applicable; otherwise, the date on which the CPS closed its file on the ex-headmaster.

(28) Confirmation as to whether the CPS or predecessor agencies have, now or at any time since World War II, given the instruction to prosecute any other faculty or staff employed by, or regularly working at, Stowe school (also including peripatetic sport, music and other instructors, tutors, psychologists, therapists, counsellors, photographers, journalists, military representatives, and religious or spiritual representatives) in connection with alleged offences committed at Stowe, OR whether the CPS has ever considered doing so (e.g. by preparing a case(s) that was/were subsequently abandoned).

With respect to the above, confirmation as to the names of any such faculty, staff or other persons associated with Stowe school whom the CPS or predecessor agencies may have prepared cases on, and/or given instructions to prosecute.

Also descriptions of the charges (or charges considered by ) any such previous prosecutions or CPS files; whether any of the cases went to prosecution and trial; the trial date(s) if applicable; the court judgements if applicable; whether the CPS appealed any court judgments, and the results of any such appeal(s).

Dear Crown Prosecution Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of the Crown Prosecution Service's handling of my FOI request 'Details of a prosecution'.

According to the response I received:

"An individual’s possible involvement with the criminal justice system is rightly open and transparent through the court process ..."

Indeed. And I want to know about an individual's "involvement" with the criminal justice system *THROUGH THE COURT PROCESS* about which the CPS must "rightly" be "open and transparent" as the CPS affirms.

Since I was not able to attend the defendant's court trial in person, I request the CPS to supply me with (at least minimal) details about said court trial, on the basis that *a citizen's ability or inability to be physically present in a given court room when a court trial is held should have no bearing on the citizen's right to know*.

Had I been present in the court room, I would not need to be making this Freedom of Information request to the CPS, because I would have heard and seen *at first hand* the information I require coming from the mouths of the judge/magistrate and barristers.

I could not be there. I should not be denied the same openness and transparency as every member of the public who was there.

The CPS' appointed barrister publicly confirms on his Chambers' website that the court trial of an ex-headmaster of Stowe school took place. Only two ex-headmasters were still alive post-2012 when the court trial took place. The defendant in the court trial was EITHER Christopher Turner OR Jeremy Nichols. I wish to know which - information I would know as my right had I been able to attend their court trial.

Again, please provide me with at least minimal details about the court trial. It cannot be right that openness and transparency is granted to citizens who are physically present but denied to citizens who can't be physically present, and you must respond to my request for (at least minimal) details accordingly.
