Thank you for your recent request for information. We received your
request on 4 December 2017.
 
We have considered your request under the Freedom of Information Act
2000. 
 
Your request
 
In your email you asked, “Please disclose Decision Notice: FS50566266.…”
 
Our response 
 
I can confirm that we do hold the requested information. However, we took
the decision not to publish this decision notice at the time.
Although this case has been subject to Appeal, it is not the ICO's policy
to publish personal data and we have not altered our position. Therefore
we are withholding the decision notice for the reasons set out below.
 
We have withheld decision notice FS50566266 in order to protect the
identity of the third parties concerned.
 
This personal information is exempt from disclosure to you under section
40(2) of the FOIA which, by virtue of section 40(3)(a)(i), allows a public
authority to withhold information from a response to a request under the
FOIA when the information requested is personal data relating to someone
other than the requester, and its disclosure would contravene one of the
data protection principles.
 
The release of this information may have a detrimental or distressing
effect. Therefore, we consider that such a disclosure would be unfair and
in breach of the first data protection principle which states that –
“Personal data shall be processed fairly and lawfully …”  It is for this
reason that we have taken the decision to withhold this information from
you in reliance on section 40(2) of the FOIA.

The appeal which you refer to in your response I assume is the source which drew my attention to the Decision Notice reference number. If so, I would like to know what the outcome was regarding any costs awarded, re the following:

"47. In the light of the Appellant’s conduct in bringing and conducting this appeal the ICO is invited within 21 days of the date of this decision to make observations with respect to the issue of costs and to indicate its costs of defending this appeal. When the tribunal has received this information it will make further directions to give the Appellant time to respond to the question of whether costs should be awarded and if so the amount of any costs.

We are now in a position to provide you with a response to your request
for information to the Information Commissioner’s Office (ICO).
 
We have dealt with your request in accordance with your ‘right to know’
under section 1(1) of the Freedom of Information Act 2000 (FOIA), which
entitles you to be provided with any information ‘held’ by a public
authority, unless an appropriate exemption applies.

Request

In your request received on 3 January 2018 you asked for the following
information:

“The appeal which you refer to in your response I assume is the source
which drew my attention to the Decision Notice reference number. If so, I

We understand that your request relates to freedom of information case
reference FS50566266. The request above follows on from a prior one you
submitted to us for the Decision Notice associated with that case and the
subsequent appeal to Tribunal, which we responded to under request
reference IRQ0714514.

Response

In response, we do not hold the outcome with regard to any costs awarded
as part of the appeal case. At this time there has been no decision from
the Tribunal shared with the ICO on the matter of costs.

We appreciate you might find this disappointing, but as we do not hold the
information requested that concludes our response.

for information to the Information Commissioner’s Office (ICO).
 
We have dealt with your request in accordance with your ‘right to know’

On 22 March 2018 you requested the following information in the form of an
update:

We understand that your request relates to freedom of information case

of the associated appeal case. We responded to that request under
reference IRQ0718391 on 25 January 2018.

Response

In response, we are able to confirm our position, which has not altered
since we issued our response to you under IRQ0718391. At this time there
has been no decision from the Tribunal shared with the ICO on the matter
of costs. The only update we can therefore provide in relation to your
request is that we still do not hold the information.
