Deaths of registrants whilst undergoing Fitness to Practise Investigation

Dear General Dental Council,

This is a request under Freedom of Information Act 2000 (FOIA).

A previous FOI request submitted by Liz Miller to the GDC in 2014 indicated that the GDC does not explicitly capture information relating to how many fitness to practise (FtP) cases have closed due to death of the registrant.

I would also like to refer you to an FOI submitted by Helen Bright to the GMC requesting information regarding doctors who died whilst under a GMC investigation, and was provided with most of the information she requested:

With this in mind I believe the GDC can provide the information Liz Miller requested, and further it is in the public interest that the information is disclosed. Please note that the Data Protection Act 1998 applies to living individuals, not deceased ones.
Therefore:
1. Please confirm that the GDC has an internal reporting system (such as the GMC's Significant Event Reporting) which would recorded any death of a registrant whilst under a fitness to practise investigation.

2. Please could you provide information on gender and age of dentists who died whilst under investigation by the GDC for a fitness to practise (FtP) matter. Please provide this information in tabular form as raw data i.e. for each dentist their name, age, gender, year in which they died, and at what stage of the FtP process they were at when they died.

3. Please, state when you started collecting this data.

4. Please provide information as to whether the GDC has received any reports from a coroner regarding a death at any time. If so, please state the nature of these reports and specifically if they related to suicide.

5. Please, state if there has ever been any investigation into the deaths of those dentists by GDC.

6. Please, state if you are aware that there is any ongoing investigation (not necessarily by the GDC) into the deaths of any of those dentists who died following referral to GDC.

I appreciate that this request may need longer time than the FOIA allows, and I have no problem with this, but please do keep me updated on the progress of my request.

Dear Eleanor Poole,

Thank you very much for providing this information and I apologise for taking a while to respond.

I think that Article 6 (Presumption of Innocence) would apply to the redacted names, therefore there is an argument to support the release of those names. However I accept that it is very sensitive.
I do believe that there is a significant public interest in demonstrating whether there have been any suicides of registrants undergoing GDC FtP procedures, given that the GMC have identified 28 and it is alleged that 13 of those may have been preventable. If there are no suicides during GDC FtP procedures, then there is a significant public interest in that information being available.

Therefore I would like to request a review that either the names or the cause of death are released.
