Dear JCIO,
1 Can you tell me the date on which Ms J*** K****** ceased being employed by the JCIO? In order to respect her privacy, I will henceforth refer to her by her initials, J K. To assist identification: she had been employed by the JCIO for at least 6 years. She was a Caseworker, not a Senior Caseworker. She was the Caseworker assigned by the JCIO to investigate a complaint about Chamber President Mrs Justice Farbey. She began her investigation on the 20 April 2021 and sent me the report on the findings and conclusion of her investigation on the 6 August 2021.

2. Can you tell me whether it was her decision to leave the JCIO? Did she retire, or resign, or was her employment terminated by the JCIO?

I realise the 2nd question is unusual, and the response of the JCIO would – in normal circumstances – be to refuse to answer it. In this case, however, the circumstances are exceptional: a complaint about Ms J K’s handling of the investigation of the complaint about Judge Farbey in 2021 had been made to the JACO. That investigation is shortly to begin. The principal witness the JACO would obviously want to question, is Ms J K, the case investigator. They cannot now do that because she has left the employment of the JCIO.

I am confident that the JCIO would wish to do everything possible to assist the JACO in their investigation by waiving their normal objection to the 2nd question. This would help to facilitate the administration of a fair and just assessment of the complaint about Ms J K’s handling of the investigation. The fact that Ms J K’s investigation was closely monitored by Senior Caseworker Manager, Naz Rasul, that she was frequently applying to him for advice, makes the answer to question 2 all the more relevant.

Given the JCIO’s obligation to assist the JACO, can I ask them to respond to a FOI Request I made to them on the 10 June 2022. I wrote to them on the 9 July saying:
‘You should by law have now responded to my FOI Request about the 'Number of times the JCIO has conducted an investigation in collaboration with the Judicial Office'.

You should have responded by the 8 July. It is now the 23 July and I have heard nothing from you.

Clearly, there is now an additional urgency for you to respond asap.
