Data breach prosecutions

Martin Keegan made this Rhyddid Gwybodaeth request to Crown Prosecution Service

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Roedd y cais yn rhannol lwyddiannus.

Dear Sir or Madam,

I am writing to request the following information under the Freedom of Information Act:

how many prosecutions has the CPS made in relation to data breaches by public servants in each of the last five years? if possible, please break this down by offence (e.g., misfeasance in public office, similar common law offences, or offences under the Data Protection Act)?

what policies has the CPS developed for deciding whether to prosecute for such offences?

what analysis has the CPS made on the potential impact its enforcement actions (or decisions not to act) have on the size and profitability of any black market in illicit personal data?

in what month did the Crown Prosecution Service become aware of the facts of the Information Commissioner's Office's "Operation Motorman" investigation into illicit data gathering, which led to its "What Price Privacy Now?" report circa 2006?

what discussions has the CPS had with ministers, police or the Information Commissioner's Office in relation to these matters, and in what month did such discussions, if any, begin?

Yours faithfully,

Martin Keegan
