Current Schedule of Contracts

Henry Baker made this Rhyddid Gwybodaeth request to Education and Skills Funding Agency

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

We're waiting for Henry Baker to read recent responses and update the status.

Dear Education and Skills Funding Agency,

I would like to request the current “Schedule of Contracts” information from the department that deals with procurement. I understand that there is a legal requirement for public bodies to compile a register of contracts detailing, but not included to:

• What the contract is for
• Who the contract is with
• The contract value
• The length of the contract
• The start and expiry date of each contract
• Any other supporting information.

Yours faithfully,

Henry Baker

Dear Mr Baker

I refer to your request for information dated 16 October.

You requested:

“the current “Schedule of Contracts” information from the department that
deals with procurement. I understand that there is a legal requirement for
public bodies to compile a register of contracts detailing, but not
included to:

• What the contract is for

• Who the contract is with

• The contract value

• The length of the contract

• The start and expiry date of each contract
• Any other supporting information”

The Education and Skills Funding Agency (ESFA) is an executive agency of
the Department for Education and any contracts relating to our work are
therefore issued by and in the name of the department rather than the
ESFA.  However, I note that you have made an identical request of the
department on the same day, so the information you have requested falls
within the scope of that request.  I will therefore close this request
which would otherwise duplicate any element of information separately
requested.

If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.

If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter.  Your complaint will be considered by
an independent review panel, who were not involved in the original
consideration of your request.

If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner’s Office.

Yours sincerely

Dear Henry Baker

Thank you for your request for information, which was received on 16th
October 2018. You requested:

I would like to request the current “Schedule of Contracts” information
from the department that deals with procurement. I understand that there
is a legal requirement for public bodies to compile a register of
contracts detailing, but not included to:

• What the contract is for

• Who the contract is with

• The contract value

• The length of the contract

• The start and expiry date of each contract

• Any other supporting information.

I have dealt with your request under the Freedom of Information Act 2000.

There is no legal requirement to hold a “schedule of contracts”. The
Department publishes information about its contracts through Contracts
Finder.

Under section 12 of the Act the Department is, therefore, not obliged to
comply with your request.  We do have a central record of some contracts
which I am able to supply to you and that is attached.

I have considered ways in which your request might be narrowed or limited
in order to reduce the cost of complying with it.  However, due to the
nature of your request and the way in which the information is held within
the Department I do not consider that the Department would be able to
provide the information you have requested without exceeding the cost
limit at this time.   We are currently building up the central record of
contracts and we may be able to provide more information if you wish to
submit a request in the future.

If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.

If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter.  Your complaint will be considered by
an independent review panel, which was not involved in the original
consideration of your request.

If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner’s Office.

Yours faithfully
