Current and historical Registers of Interest data

We're waiting for Ally Tibbitt to read recent responses and update the status.

Dear Common Council of the City of London,

Please treat this email as a Freedom of Information request.

I would like to receive a copy of the complete current local authority Register of Interest for all elected politicians in a machine-readable spreadsheet format such as a CSV file, including any additional information that may not be published on your website.

If you hold records relating to historical registers of interest for current and former elected politicians I would be grateful if you could also supply them.

I would also like to receive a copy of the complete current local authority Gifts and Hospitality Registers for all elected politicians in a machine-readable spreadsheet format, including any data that may not be published on your website.

If you hold historical records of gifts or hospitality received for current and former elected politicians I would be grateful if you could also supply them.

Lastly, if you hold a separate register of interests that records those declared at meetings, please also supply that register in a machine-readable spreadsheet format. Again, if you hold historical records of declarations that may not be published on your website, please supply details.

I would prefer not to receive the requested information in pdf format files.

If the requested information is published as open data, please could you supply the location where this data can be found.

FREEDOM OF INFORMATION ACT 2000 (FOIA) – REQUEST FOR INFORMATION

 

The City of London (CoL), sometimes also called the City of London
Corporation, acknowledges receipt of your two identical requests for
information of 25 February 2020, both timed at 14:48.

 

(Please note that, although the WDTK site lists the CoL at two places
under two different names –

- where your identical requests are listed, the CoL is in fact one legal
entity. Its full, official name is ‘The Mayor and Commonalty and Citizens
of the City of London’. We have informed the WDTK website that it is
maintaining two sections for one body, and that it would be less confusing
for applicants if the site referred to the CoL under one name instead of
maintaining two lists and two names for the same legal entity, but it has
declined to make the change. For further clarification of the position of
the CoL under the FOIA, please see Paragraph 9 of Schedule 1 of the FOIA,
which describes the CoL as being subject to the FOIA with regard to 'The
Common Council of the City of London, in respect of information held in
its capacity as a local authority, police authority or port health
authority').

 

Public authorities are required to respond to requests within the
statutory timescale of 20 working days beginning from the first working
day after they receive a request. The Act does not always require public
authorities to disclose the information which they hold.

 

The FOIA applies to the CoL as a local authority, police authority and
port health authority. The CoL is the local and police authority for the
“Square Mile”, ie the historic City of London, and not for London as a
whole. Please see the following page containing a link to a map (‘Explore

The CoL does have some functions, including Port Health Authority

We have been unable to provide the historical data, that we confirm we do
hold, in the FOIA prescribed timeframe, but aim instead to make this part
of the response to you by close of 22 April 2020 or sooner if possible.

 

We apologise that we are unable to fully respond to your request today,
which is the statutory deadline. This has been because of the competing
pressures of other/statutory duties and the fact that the number of FOI
requests we manage is constantly increasing, and the added requirements
brought about by the Covid-19 virus resilience programme work, which are
all placing a considerable burden on our resources. Nevertheless, the
failure to meet the deadline for your request does not meet our normal
standards (since the Act came into full force in 2005 we have replied
annually to between 93% and 98% of requests within the statutory
deadline).

 

As stated above, we aim instead to make the final part of this response to
you no later than 22 April 2020 or sooner if possible.

responds as follows:

Please find attached the historical data initially requested in question
2.

With regards to the attached document, please see our section 40(2) FOIA
exemption below.

 

Section 40(2) exemption – Personal Information

Parts of the attached document contained personal information relating to
other people and this information has been redacted in accordance with
Section 40(2) of the Freedom of information Act.

 

The CoL is applying the FOIA Section 40(2) exemption (personal
information) to any elected members’ names that are not already on the CoL
website or otherwise routinely in the public domain.

 

A public authority has to consider a disclosure under the FOIA as a
disclosure to the world. We note the Information Tribunal’s statement that
“Disclosure under [the] FOIA is effectively an unlimited disclosure to the
public as a whole, without conditions” (Information Tribunal Appeal
Decision EA/2006/0011 & 0013), which was also referred to by the
Information Commissioner (Information Commissioner's Decision Notice FS
50294078).

 

In addition, the Information Tribunal has upheld the view that "to release
the name of an individual’s employer would be to release significant
personal data" (Appeal Number EA/2007/0058), except, of course, where the
information is, as mentioned, already routinely in the public domain.

 

In view of the Tribunal's various statements, we have to consider whether
disclosure would constitute a breach of the Data Protection Principles
under the General Data Protection Regulation (‘GDPR’). In this instance,
we consider that Principle 1 under Article 5(1)(a) of the GDPR would be
breached by disclosure i.e. the principle of lawfulness, fairness and
transparency. The CoL considers that there is no general expectation by
individuals of routine disclosure of such information under the FOIA.

 

In conclusion, with regard to this exemption, the CoL does not see any
legitimate interests in the public routinely having access to this
information, and considers that disclosure would not pay due respect to
the rights and freedoms of the data subjects, i.e. the people whose
information it is. Similarly, we do not see any conditions under Article
6 (which concerns conditions for processing personal data) of the GDPR
which would permit disclosure.

 

Under the FOIA the section 40(2) exemption is an absolute exemption, ie it
is not subject to the public interest test.
