Dear HM Revenue and Customs,

In a recent Response to a Request for Information you disclosed the following:

"HMRC establishes its own Criminal Justice Procedures for the execution of PACE and POCA powers, including cash seizure under Part 5 of POCA". "These Procedures are a distillation of the legislation as written, including amendments, the associated POCA Codes of Practice and learning from operational experience of HMRC officers executing cash seizures."

Please disclose HMRC's "own Criminal Justice Procedures" (for PACE and SOCA).

July.

Thank you for writing in connection with my Request for Information.

I asked for HMRC's "Criminal Justice Procedures" (refined to only the policy of procedure used or followed for the purposes of The Police and Criminal Evidence Act and The Proceeds of Crime Act).

[Without finding the Requested documents etc.] you confirmed that HMRC hold recorded information (the Criminal Justice Procedures) but no one in HMRC could locate the Procedure or Policy documents in under three and half days so cannot disclose the Requested Information as this would become too expensive to find-out. It took you a Month to realise that it would take more than three and a half days to search for the Requested Criminal Justice Procedure (PACE / POCA). You confirmed that my Request could not be narrowed any further (having been so narrowly drafted in the first instance). You for these reasons Refused my Request.

If I feel an Internal Review is appropriate, I will make an Application in due course.
