Dear Renfrewshire Council,

Thank you for your response. I would be obliged if you could check the response for accuracy as there is no mention of the other teams in the authority who will also be undertaking criminal Investigations such as trading standards, environmental health, planning enforcement etc.

Several authorities have provided a revised response after taking consideration of the above without the need for request of internal review. I trust that the same position will also apply.

Yours faithfully,

James McKay

Renfrewshire Council

Dear Mr. McKay,

I have spoke with the relevant sections regarding your request and have
the following update to provide. It is worth noting that the differences
between the initial response provided and the updates below are due to the
fact that while the officers may undertake this work on occasion, they are
not defined as being employed specifically to conduct criminal
investigations.

For instance, officers such as Environmental Health Officers undertake a
wide variety of work, and wherever possible seek to support legitimate
business, and encourage compliance rather than enforcement.

In the case of of Planning, the last time a report was made to the
Procurator Fiscal was approximately two years ago.

The updates below have been provided on basis of the clarification that
your request was relating to any officer involved in activities relating
to your request, however infrequent, as opposed to employees specifically
employed to carry out criminal investigations.

1)        The number of employees in authority that are employed to
undertake criminal investigations.

In addition to the information previously provided, Renfrewshire Council
has 35 other officers who deal with criminal investigations as part of
their duties.

2)        Details of the designation of all of the above employees.

In addition to the information previously provided, Renfrewshire Council
has the following:

+------------------------------------------------------------------------+
| Department | Designation |
|------------------------------+-----------------------------------------|
| Trading Standards | Trading Standards & Licensing Manager |
| | (1) |
| | Trading Standards Officer (4) |
| | Authorised Officer (2) |
|------------------------------+-----------------------------------------|
| Environmental Health Service | Business Regulation Manager (1) |
| | Environmental Improvements Manager (1) |
| | Environmental Health Officers (12) |
| | Senior Technical Officers (1) |
| | Public Health Enforcement Officer(1) |
| | Public Health Technician (1), |
|------------------------------+-----------------------------------------|
| Community Safety Service | Enforcement Manager (1) |
| | Project Coordinator (1) |
| | Wardens (6) |
| | Assist Investigator (3) |
+------------------------------------------------------------------------+

3)        The number of the above employees who have undertaken training
in respect of Part 6 of the Criminal Justice and Licensing (Scotland) Act
2010?

In addition to the information previously provided, Renfrewshire Council
has 35 officer from the figures above who have completed training

4)        If any of the above employees have not undertaken training in
respect of Part 6 of the Criminal Justice and Licensing (Scotland) Act
2010 please provide details of procedures in place to reduce the risk of
miscarriages of justice occurring?

Not applicable.

5)        The number of employees who are trained to perform the role of
Senior Investigating Officer, Reviewing Officer and Reporting Officer?

+------------------------------------------------------------------------+
| Department | Number of Employees |
|-------------------------------------+----------------------------------|
| Senior Investigating Officer | 3 |
|-------------------------------------+----------------------------------|
| Reviewing Officer | 6 |
|-------------------------------------+----------------------------------|
| Reporting Officer | 38* |
+------------------------------------------------------------------------+

*All officers can be reporting officers, but only some can be
senior/reviewing officers. In addition, there are three Planning Officers
that are trained to be Reporting Officers who can submit reports to the
Procurator Fiscal, but they do not conduct criminal investigations and so
have not been included in the responses for Points 1-4.

I hope this clarifies our response for you, please contact me if you have
any further queries.

Sincerely,

Joseph Bartoletti
