3. -How many current GMC staff have received a warning or caution by the police
4. -How many current GMC staff (any department including MPTS and Outreach) are under Police Investigation.

Obviously, it is a breach of your contract not to inform your employer or contractor, thus you should have accurate numbers readily available via your Human Resources department.

I am obviously the complainant for yet another criminal investigation of GMC staff. Although, your private Quango company obviously self-prosecutes another self-complaints in-house against me, legally this is not an excuse to refuse a request for a FOIA request, given Public Interest in the request itself. I require this information for a month-long hearing next month. Thus, I do require the information within 20 working days please. If you plan to refuse the request or use Julian Graves, then can it be stated now with a copy of the public interest test, rather than having to request an internal appeal after 20 working days which only illustrates bad-GMC-practice non-transparent governance.

Please provide information as a PDF on GMC headed paper, following your standard requirements, so it can be submitted to a GMC MPTS tribunal by any doctor defendant.

Given ongoing Regulatory Chamber proceedings and actions against whistleblowing doctors. You are fully aware one of your colleague will stand as a witness against a doctor after GMC-entrapment to consider your own complaints despite Greater Manchester Police Criminal Investigation of her for theft of occupational health records from a third party and distribution without consent including amongst GMC staff to create a case. The extent of this is unclear especially as other GMC MPTS staff have criminal investigations opened and continue to be employed without restrictions despite the Public Interest. The information for this request is to be submitted to yourselves and is clearly a priority request. Due to historical refusal and actions against transparency, it is done on an open platform by an elected representative. I would appreciate if you can do the needful and provide the information before 16th October 2023 or escalate on day 20 of this request to an internal review as originally directed.

I’ve now had the opportunity to consider your request under the Freedom of
Information Act 2000 (FOIA).

 

I can’t provide the information you have asked for because I consider that
your request fits the criteria of a vexatious request.

 

The Information Commissioner, the body responsible for upholding
information rights, has published guidance on this with set criteria for
us to consider. Specifically, I believe that your request is designed to
cause disruption and annoyance to MPTS and GMC staff rather than to seek
information. The following exemption, set out in the FOIA, applies:

 

Section 14(1). The effect of this exemption is that we do not need to
respond to a request for information if it is vexatious. I should stress
that this is a judgment on this request alone and not on you as a
requester.

 

You do have the right to appeal against my use of this FOI exemption. If
you wish to appeal you should e-mail the Information Access Manager at
[1][GMC request email]. and set out your ground(s) for making an appeal. If
such an appeal were unsuccessful you would have the right to make a
further appeal, to the [2]Information Commissioner's Office,  the

Please pass this on to the person who conducts Freedom of Information reviews. I am writing to request an internal review of General Medical Council's handling of my FOI request 'Criminal GMC Staff'.

ICO guidance also states that Section 14(1) is applied because of the nature of the request rather than the consequences of releasing the requested information (see https://ico.org.uk/media/for-organisatio...). This request is a very serious specific request based on circumstances and public interest. It is clearly for a defined and time specific purpose despite deliberate delays and can be used by other members of the public. The request is not trivial, my language has been very muted but clearly I have a Public and Professional mandate to make requests and hold quasi-public bodies accountable. Despite phone call you have not suggested alternatives, whilst GMC Legal have persistently refused mediation.

Given history actions appear malicious, despite request wording, I understand you have deliberately waited until after day 20 to refuse this request with Section 14(1) and refused to consider prior directions for internal review in the request, written on the basis of probability. It is awkward and leaves me having to submit a second public internal review in the Public Interest which is through no fault of my own. The request is to obtain public information that a relevant tribunal and the public have a right to know and use to balance information and or submissions. If the GMC choose to focus on non-medical matters and also choses to use their own staff as witnesses and self-complainants to pursue anti-whistleblowing agendas (background – Bewick Reports). Then relevant related questions about staff should asked and be disclosed, obviously in the public interest the extent of objective criminal activities by your current staff is relevant. You are clearly aware of the misuse of Section 14(1) and with dossier collections at the General Regulatory Chamber, it is apparent resources have been used on circumventing and refusing FOIA requests, this is against openness and transparency.

You/GMC are fully aware of the nuances of GMC procedure as well as ‘prosecution at all costs’ and ‘race discrimination’ ethos. With an FOIA request this should not be factored in as it is against natural justice and the UK Equality Act.

Given the General Regulatory Chamber GMC submissions and having spoken to you, I clearly contest your statement “I should stress that this is a judgment on this request alone and not on you as a requester.” It does appear to be me as the requestor, may I remind you that the FOI Act requires an 'applicant blind' approach, which is to say that it embodies the principle that information is available to anyone and requests must be assessed without consideration of who made them. Contrary to the ICO's guidance (see https://ico.org.uk/media/for-organisatio...), your decision has been influenced by your knowledge or view of me as the requester, rather than an assessment of the request in isolation. For that reason I am asking you to review your response and, if the exemption is upheld, to provide an assessment which does not take your knowledge of the requester into consideration.

Further to you returning my telephone call, you highlight wrongly the only route of obtaining the information to submit to yourselves is by appealing this to the GMC IAT, which I do again, here. The other option which I highlighted was a Rule 34(8) letter demand and forcible disclosures with section 35 of the medical act through the GMC MPTS and likely preliminary hearing. You are aware a preliminary hearing has already occurred and time is an issue. As the information is needed to highlight the unnatural witnesses the GMC employs and objective criminal extent of their backgrounds in tribunals, I have little choice but to address this with a tribunal and have put you on alert, given the GMC history of persistent refusal of disclosures despite civil procedure rules.

Although you use a template, given the organisation you work for, as you actively undermine the public perception of the medical profession, you do need to stop attempting to degrade doctors and address them correctly.

This request was made on the 19 September, 41 days ago, with anticipation of bad information practice given history it is likely you already have a response to Internal Review and are waiting until 14 November. Thre are far too many examples of bad-GMC-practice througout the GMC. It would be more appropriate and in keeping with the law to provide the response ASAP.

I write further to previous correspondance with an appeal response.

 

I agree with my colleague Mr Ellen that your request meets the definition
of being vexatious and thus I uphold it's use in respect of this request.

 

I believe this is justified, in broad terms, for the same reasons that the
ICO set out in their previous decisions concerning you and our use of S14.
As those decisions make clear, it is both legal and legitimate for the GMC
to consider factors personal to you when considering applying S14 to your
request. This is completely in line with case law and the ICO's guidance.
I’d also note that your request and appeal conflates two separate
processes- the conduct of our fitness to practise function and our
information access function.

 

As you should know, an assessment of whether S14 is appropriate is based
on the ‘four broad themes’ of burden; motive; value or serious purpose and
harassment or distress to staff as set out in by the Upper Tribunal
Information Commissioner vs Devon County Council & Dransfield [2012] UKUT
440 (AAC).

 

The Upper Tribunal also explained that:

 

‘all the circumstances need to be considered in reaching what is 
ultimately a value judgement as to whether the request in issue is 
vexatious in the sense of being a disproportionate, manifestly 
unjustified, inappropriate or improper use of FOIA.’

 

We believe that our use of S14 is justified for reasons including:

 

• The aggregate burden of dealing with your overall correspondance has
placed a burden on the resources of the GMC;
• The motive, at least in part, is to discredit the GMC and vent your
displeasure about an investigation involving you;
• Far from being ‘muted’ your request, appeal and other public remarks
(including that the GMC had implemented ‘a fascist system of control’)
are of a similar kind to that which has previously been commented on
adversely by the ICO;
• The value is limited in as far as it is, to a notable extent, to
further your own private interest of your own defence in GMC
proceedings. It is further limited as the GMC confirmed [1]last year
that no GMC staff had an unspent conviction at that time. It is
unreasonable to expect that the GMC would hold conviction information
for the whole of our employee’s lifetimes.

 

The details of the ICO for the purposes of an appeal are well known to you
so I do not propose to repeat them below.

As discussed with Mr Ellen, it is clear the GMC continue an escalating campaign of spiteful abuse of FTP and refusal to provide information given inequality of arms. It appears he has somewhat listened so Mr Greaves is not responded.

You misunderstand your one-way FTP processes, it they were not present and escalating my requests would not be present. The current panel had your department’s actions discussed for the reason it was clear it was not the request but the person you were taking action against in the Section 14 refusal which is unlawful. The ICO guidelines allow local resolution and previous tribunals have directed limited disclosure but not including FOIA as these they said are separate and repeated failure to resolve is for the General Regulatory Chamber via the ICO.

This request shows your actions are deliberate and pre-planned, waiting to act is deliberately wasting time to ensure that FTP Rule 34(8) letters are not sent to the GMC, you thus attempt to curtail any defence as fairness to a doctor is against GMC practice principals.

Section 14 should be used on the request and not the requester and thus GMC actions are unlawful. Given past and current General Regulatory Chamber proceedings, you are aware and actively attempt to abuse that S14 FOIA. Such exemption is only appropriate if based on the ‘four broad themes’ of burden; motive; value or serious purpose and harassment or distress to staff as set out in by the Upper Tribunal Information Commissioner vs Devon County Council & Dransfield [2012] UKUT 440 (AAC).

***Burden – The burden is actually on the doctor whom has had to spend at least 80 days this year on GMC issues and failures whilst only a few targeted FOIA were made. The request here is a simple one where a good organisation should keep a risk register so information would be available within 5-10minutes.
***Motive – The motive is for information for defence in reaction to prosecution action. This is not a chicken and egg scenario as prior GMC action is always preceding and this has been going on for 7 years but only relatively recently have FOIA used with knowledge the GMC IAT given hatred of transparency detest the whatdotheyknow public platform. The GMC in actively refusing disclosures posy prior whistleblowing continue to use any desperate attempt to refuse disclosures.
***Value and serious purpose – the information request is always phrased to be generic and be of use to nay doctor and is clearly in the Public Interest, there is no shadow of a doubt about that. There is an additional value to be used in a specific Kangaroo GMC MPTS tribunal that you quote and thus your department actions are with insight and oversight of GMC Legal.
***Distress to staff – Given the Public Interest, here for staff with active criminal activity working at the GMC, there needs to be a balance of Interest test; this has not been provided. Mr Ellen has been apologetic and clearly annoyed at the possibility of Rule 34(8) which highlights the request has not been distressing but an alternative route for information is distressing. The distress to staff is clearly minimal beyond not getting additional pounds of flesh or causing suicide of doctors, the latter is unfortunately is a GMC purpose and I would highlight the ‘Deadpool’ you have displayed on the 4th floor office walls of 4 Hardman Street.

Overall it is unfortunate to have this expected response given cross-prosecution and a complaint will be made to the Information Commissions Office as actions are deliberate with planned ill intent.
