Dear Mr Jacobsen

REQUEST

Please can you tell me how many children at the age of 10 or below the age
of criminal responsibility have been found responsible for crimes in the
police area and which towns they were in for the past five years (2012 -
2017)

RESPONSE

Please see the attached document

Please note: we do not hold a suspect’s age on our crime recording system.
We can make a calculation of the suspect’s age based on the difference
between their date of birth and the date the crime first occurred from.
This is not always accurate, particularly for historical offences which
occurred over a period of years. Therefore we cannot guarantee that the
data included in this response is accurate.

We don’t record children under 10 as being offenders (i.e. responsible for
crimes) as they are below the age of criminal responsibility.  For example
if a 9 year old was responsible for a criminal damage, an unsolved crime
outcome would be used.  The 9 year old would be linked to the crime as
‘Subject’ or ‘Suspect’ party classifications.  Prior to April 2017, they
could also have been linked as ‘Young offender’ or ‘Offender’.

Please find details of recorded crimes between Apr 12 – Mar 17 where one
or more nominal aged 10 or under* was linked to the crime as: -

·         Subject

·         Suspect

·         Young Offender

·         Offender

·         The party classification of ‘Subject’ can be applied for a
variety of reasons, this is not restricted to use where the nominal has
committed a crime

·         A nominal who has been given a party classification of ‘Suspect’
may subsequently be given a party classification of ‘Eliminated’, the
attached data may include examples of these

If you are not satisfied with the decision applied in this case I enclose
for your attention a copy of the Constabulary's appeal procedures.

Regards
