Dear Avon and Somerset Constabulary,

Under the FoI act I would like to submit the following for information.

During 2018, How many people classed as IC1/IC2 (combined) were arrested (charged or not) by officers of your force area for the following.

1. Breach of the peace
2. Hate Speech specifically against disability, race, religion, sexual orientation or transgender identity
3. Section 5 of the POA

and during 2018, how many people classed as IC6 were arrested (charged or not) by officers of your force area for the same

1. Breach of the peace
2. Hate Speech specifically against disability, race, religion, sexual orientation or transgender identity
3. Section 5 of the POA

under the Freedom of Information Act.

 

Specifically you asked:

Our response:

Unfortunately our custody system does not record information in the way
you have requested it. (IC codes) so we are unable to respond to your
request.

system.

Our response:

Unfortunately it is still the case that this information is not recorded
in a way that facilitates an electronic search to extract it. There is no
specific offence of ‘hate speech,’ we do record hate related offences
however although there maybe mention of ‘hate speech’ within the crime or
custody record this is not a specific offence that we can search.

 

I apologise that you were not informed of this in your previous response,
however you may wish to re-submit your request for information for
statistics relating to breach of the peace and hate related crimes with
the breakdown of the offender/suspect ethnicity.
