I write in connection with your request for information which was received

Please find the Warwickshire Police response set out below.  When
reviewing the information please note that, due to changes in systems, it
is not possible to retrieve information prior to October 2017.

 

Response:  Searches were conducted for all offences between 1^st January
2018 and 11^th May 2023 that have a marker of ‘Involved Asylum Seeker’,
this produced a nil result.  However, this is not mandatory and in the
event that the marker is not selected then information will not be
returned and, therefore, searches conducted in this way cannot be assumed
to be accurate.

 

Information may be recorded about someone having claimed asylum which is
not apparent at the outset of the crime being recorded, and may become
apparent further into an investigation.  Therefore, in order to determine
the number of times it has been recorded that a suspect or victim had
claimed asylum, it would be necessary to review the wider investigation
documentation of all crimes recorded in the period.  This would be above
the amount to which we are legally required to respond i.e. the cost of
locating and retrieving the information exceeds the ‘appropriate level’ as
stated in the Freedom of Information (Fees and Appropriate Limit)
Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of the request and, if one part of a
request exceeds the fees limit, then S12 of the Act applies to the whole
request.

 

In accordance with Section 16 of the Act I have a duty to provide advice
and assistance in relation to your request; however, due to the volume of
records involved, I am unable to advise of a way to revise this element of
your request to one which could be carried out within the fees limit.

 

With regard to Q4 and Q5 of your request, there is no field on the crime
recording system which captures whether someone is a British Citizen. 
There is a field where nationality may be recorded; however, this is not
mandatory and is often not filled in.  However, even where nationality has
been completed, this would not denote that the individual was not a
British Citizen. 

 

As a gesture of goodwill I have provided a response to Q1 which is set out
below.
