Dear Mr Slater,

Freedom of Information Request F21-302

Thank you for your request for information as copied below. You have asked
four questions about MPs who have been advised to isolate due to having
Covid, or have been in close contact with someone who has had Covid, which
we have sought to answer below.

In the first instance, it may help you to know that Members of Parliament
are not employees of the House of Commons Administration and we are not
responsible for organising or administering their healthcare arrangements.
However, during the Covid-19 pandemic, the Parliamentary Test and Trace
team has carried out contact tracing for the benefit of all parliamentary
passholders attending the parliamentary estate, including Members, Peers,
their staff and staff of both Houses of Parliament, under the guidance of
senior medical officials. All passholders are requested to notify the team
should they, or a member of their household, develop symptoms, receive a
positive test result or receive a notification that they are a close
contact. There is no obligation to do so, however. Furthermore, the
information below only covers contact tracing in Parliament and does not
cover any advice given to them through any other process.

Could you please provide details on the MP’s who have been advised to
isolate due to having COVID, or have been in close contact with someone
who has had COVID. Information required is

 1. Name

This information is held by the House of Commons. As part of contact
tracing, we hold information about which Members have been advised to
self-isolate.

However, confirmation of whether someone has been advised to isolate
constitutes their personal data. In particular, information concerning the
health of data subjects constitutes ‘special category’ personal data
which, under data protection legislation, is afforded a higher level of
protection. This information is therefore is exempt from disclosure by
virtue of section 40(2) of the Freedom of Information Act 2000 (FOIA), as
disclosure of this information to the public generally, in our view, would
not be consistent with the data protection principles in Article 5 of the
UK General Data Protection Regulation. This is an absolute exemption and
the public interest test does not apply.

 2. Did they isolate
 3. Date when they isolated

and

 4. If they didn’t isolate, why?

This information is not held by the House of Commons. This is because
passholders advised to self-isolate are not required to report this
information to us.

You may, if dissatisfied with the handling of your request, complain to
the House of Commons. Alternatively, if you are dissatisfied with the
outcome of your request you may ask the House of Commons to conduct an
internal review of any decision regarding your request. Complaints or
requests for internal review should be addressed to: Information Rights
and Information Security Service, Research & Information Team, House of
Commons, London SW1A 0AA or [1][House of Commons request email]. Please ensure
that you specify the full reasons for your complaint or internal review
along with any arguments or points that you wish to make.

If you remain dissatisfied, you may appeal to the Information Commissioner
at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9
5AF, [2]www.ico.org.uk.
