Dear Derbyshire County Council,

I am writing to request an internal review of Derbyshire County Council's handling of my FOI request 'Covid-19 risk mitigation assessments'.

In response to my request the only guidance which you indicated has been given to staff in education was the government guidelines on safe working in educational settings. This relates to the risks posed by Covid-19 including the use of things like PPE for example.

My request was about Covid-19 Risk Mitigation Assessments. On 20 April 2021, the Head of the Children Missing Education Service wrote:

"Risk mitigation forms were completed for all pupils with an EHCP to assess what provision they were able to access during the first COVID-19 restrictions. These were to aid mitigation against the risk of receiving no education when schools were closed, and included priority criteria as below:
Risk Mitigation (COVID-19) Children’s Service: SEND (EHCP) - Priority Rating
1
• Child/ young person is not accessing provision detailed in the EHC Plan.
• Annual Review is not being carried out.
• Safeguarding referral required.
2
• Child/ young person is accessing parts of the provision detailed in the EHC Plan
• No safeguarding referral required.
3
• Child / young person is accessing all provision detailed in EHC Plan.
• Child/ young person may be in a temporary education setting not the education placement named in the EHC Plan."

The understanding of the purpose of Covid-19 Risk Mitigation Assessments appears to be different depending on who is asked and why they are asked. Will you please review your response and confirm what guidance was circulated to staff in education on the purpose of Covid-19 Risk Mitigation Assessments. From 20 March 2020, HM Gov was asking local authorities to carry out risk assessments for all students with EHC plans to decide whether children were safer at home or by continuing to attend their educational setting. It is clear from the response of the Head of the CME Service that the risk assessment carried out for some students was very much more limited than this.
