Dear Lewes District Council,

This document sets out the policy of Lewes District Council in relation to covert surveillance:

Please provide the following information for each of the past five years concerning the activities of Lewes District Council in relation to covert surveillance/covert human intelligence sources:

1) How many officers of Lewes District Council have been engaged in covert surveillance?
Were any people employed, other than employees of Lewes District Council, to undertake these activities? Were any outside agencies used?

2) What type of covert surveillance activities were undertaken? This is to cover the range of surveillance, eg phone intercepts etc.

3) How many of these activities were made under RIPA?

4) How many applications were made to a magistrate under the RIPA requirements? How many approvals were obtained in respect of these?

5) Please provide an analysis of the grounds for undertaking covert surveillance.

6) What was the outcome of the cases where covert surveillance was undertaken? Were there any prosecutions, or what action was the outcome if appropriate. Please provide a breakdown of the figures to show the number of cases each year and how many were followed up by action of some kind.

I have reviewed your request and investigated whether there is any
information which can be disclosed to you.  Please find below the
information the council holds, and which I am pleased to provide to you.

The following answers relate to the five year period beginning April 2013
and ending March 2018

 

1) How many officers of Lewes District Council have been engaged in covert
surveillance? The Council does not hold this information

Were any people employed, other than employees of Lewes District Council,
to undertake these activities? Were any outside agencies used? The
Council has not employed any external persons to carry out covert
surveillance.

 

2) What type of covert surveillance activities were undertaken? This is to
cover the range of surveillance, eg phone intercepts etc. The Council may
from time to time carry out routine online checks, using open source
internet sites, to confirm a customer’s details, but this does not amount
to directed surveillance.

 

3) How many of these activities were made under RIPA? None

 

4) How many applications were made to a magistrate under the RIPA
requirements? How many approvals were obtained in respect of these? None

 

5) Please provide an analysis of the grounds for undertaking covert
surveillance. Please refer to paragraphs 4 to 8 of the Council’s Policy
Statement on the Use of Covert Surveillance which can be found via this

The Council does not hold this information

Dear Lewes District Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Lewes District Council's handling of my FOI request 'Covert surveillance by Lewes District Council.'.

The specific reasons for requesting an Internal Review are as follows:

Question number 1 of the FOI request: the number of officers of Lewes District Council, who are engaged in covert surveillance. You have stated that the council does not hold this information, however as it is clear that surveillance has been undertaken (reply to question 2) it follows that some council officers/employees have been doing this work. Please clarify the answer you have provided as it doesn't agree with information elsewhere.

Question number 6 of the FOI request: again you state that the council does not hold this information. It is apparent that the council has engaged in surveillance activities so it is to be expected there must be some sort of data in relation to this. It is unrealistic to expect that there are no details for the outcome of the cases where this was undertaken. Also, there should be information on the figures for the cases each year with subsequent action taken in respect of these. Will you please clarify the response you have provided here.
