Dear HM Courts and Tribunals Service,

Could you please provide the following dataset (or extract from a dataset):

a list of all Court of Protection hearings in England and Wales scheduled to be heard on Friday 4 August 2023 or Monday 7 August 2023.

Please provide the following for each hearing listing entry:

a) name of court
b) name of COP region in which the court is situated
c) name of judge scheduled to hear the case (or that no judge has been allocated)
d) date of the hearing
e) time of the hearing
f) names of the parties (or anonymised names of the parties)
g) a description of the case
h) whether the case is a dispute resolution hearing or not
i) whether the case is to be heard in public or in private
j) whether a Reporting Restriction or transparency order is in place
k) estimated duration of the hearing
l) whether the hearing is in person, held remotely, or is a hybrid hearing
m) if remote or hybrid, what remote hearing technology is to be used
n) details of the person to contact (email and telephone number) in order to request to observe the hearing

Please provide this information in an electronic form which is reusable ie. machine readable form (NOT pdf). (see section 102 of the Protection of Freedoms Act 2012)

I do not really understand the "complexity" argument, as the information I have requested is already published (but not in machine readable form) on Courtserve, with the exception of item j) [whether a Reporting Restriction or transparency order is in place].

You had indicated that the dataset would be released last Friday. Do you have a date for release to me, please?

I am rather keen to see what format you provide the dataset in, so I can work out what programming I might need to do to process the content.

Have spoken today (13 September) to the ICO advice line. They recommend that I submit a formal complaint to the ICO.

So have submitted formal complaint to ICO.

Dear HM Courts and Tribunals Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of HM Courts and Tribunals Service's handling of my FOI request 'Court of Protection listing dataset'.

HM Courts and Tribunals Service advised me on 6 September 2023 that the response to my Freedom of Information request submitted on 4 August 2023 was completed and was awaiting clearance for release.

You indicated that this was expected by the end of that week, which would have been Friday 8 September 2023.

It is now Wednesday 4 October 2023 which is exactly 4 weeks after you provided that update on Wednesday 6 September 2023.

The legal requirement was for HM Courts and Tribunals Service to have provided a response to me "promptly" and in any event, within 20 working days of receipt.

Could I please ask you to investigate why the response that was available for release on 6 September 2023 has still not been released and why HM Courts and Tribunals Service have breached the provisions of the Freedom of Information Act in this instance.
