Having understood your reply I can further assist you by requesting why mr hutchison was witnessed by myself grinning in a fashion that troubled me simply because of the developments in the robert green hearing. I felt that mr Hutchison was acting in a way which made me think that what had transpired in the court room regarding Roberts trial had gave him great delight for one reason or the next.

Dear Mr Pattinson,

Thank you for your email. I am afraid I am having some difficulty understanding the exact nature of your complaint about Mr Hutchison.

Perhaps if you could explain the context of what happened that would assist. In particular were you a witness or sitting in court just to hear what was happening? Did Mr Hutchison approach you directly? If so was there a reason for that? Was he speaking with someone else such as the Sheriff or defence lawyer when he made this facial expression that concerned you? At what point did he make the facial expression? Can you confirm the reason you found his facial expression troubling? Would it also be possible to clarify why you believe that Mr Hutchison's reaction amounted to inappropriate conduct? Did the Sheriff comment negatively on Mr Hutchison at all?

I'm sure you can appreciate that people smile or grin for all sorts of reasons in their personal lives and at work so I require further information about the context before I am able to investigate the full circumstances.

mr hutchison came out of the side door after sheriff fleetwood had announced he was no longer going to be involved in the robert green trial. He was smiliing profoundly and in my opinion this was a direct result of mr fleetwoods decision, especially after having a very fair and hopeful previous hearing with mr fleetwood. I strongly feel that pressure from the copfs had resulted in mr fleetwood dropping the case.

Mr hutchisons reaction told me alot and i became very suspicious due to the above factors. I have a witness to the event who can support my claims.

I am writing to request an internal review of Crown Office and Procurator Fiscal (Scotland)'s handling of my FOI request 'Court attendance'

I cannot believe the audacity on how this has be handled. No interest in responding after asking ME to clarify. I do not approve of being lied to. It seems very clear to me that the unlawful actions being committed in this Foi have no place. Furthermore the person dealing with this Foi request has no consideration of the law.

I have asked one simple question and have been met by non compliance. I know for a fact the crown office does hold records of its staff and also that free reign to do what ever they like whilst in employment cannot happen.

Having clarified matters, you requested:

As you were advised in our letter dated 5 March 2015, we treated this as a complaint rather than an FOI request as it was not a request for recorded information held by COPFS. As we did not treat your request as a request for information in terms of FOISA, we will not be carrying out an FOI review.

If you remain dissatisfied with how we have dealt with your request you are, of course, entitled to raise your concerns with the Scottish Information Commissioner.

For the reasons outlined within our letter of 5 March 2015, any further correspondence from you on the same issues will not be acknowledged or responded to and will be held on file only. I have attached a copy of that letter for your convenience.

Dear FOI Enquiries,

Then we have a clear problem with the way in which your department has handled this request and by the manner Helen knipe has reacted. Why did the response I was given request to clarify my request if it did not have anything to do with the request in the first place? The crown office has clearly misused this service.

Furthermore I have to say that when ms knipe refused to act I see this as a dereliction of duty and refusal to uphold her oath to abide by the law in investigating possible corruption. Additionally there was correspondence to me on this matter that showed clear evidence that some responses were not even signed or named and all that was present was a squiggle. Your response and actions in this matter are clearly unlawful and I demand that strict action is taken by the appropriate people. Failure to do so is unlawful
