County Court- Register- Location, Format, Access for Certified Extract

We're waiting for BERT GEISHERD to read a recent response and update the status.

Dear Her Majesty's Courts and Tribunals Service,
The County Court is obliged to maintain a Register of it's judgements, per the Courts Act 2003 (as amended 2013). Please provide the following:

1) Where the Register of the County Court is kept?
i) Whether each branch of the County Court holds it's own Register or whether the Register is now national for England and Wales (If the latter, please specify when the situation changed)

2) Whether the Register is paper or electronic? If there has been a change from one to the other, as with other courts, then please specify when the change took place and where the paper register has gone.

3) The procedure for obtaining an extract from the Register of the County Court.

nota bene:
a) Reasonable efforts have been made at the appropriate County Court which denies it has any form of Register before it had new computers in 2010
b) Please, this is NOT for matters recorded at Registry Trust.
Yours faithfully,

BERT GEISHERD

Disclosure Team, Gwasanaeth Llysoedd a Thribiwnlysoedd EM

Dear Mr Geisherd,

Thank you for your e-mail, I am writing to advise you that your enquiry does not fall under the Freedom of Information Act 2000 (FOIA) regime and has been rejected by the Disclosure Team.

It may be helpful if I explain that the FOIA gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the Ministry of Justice (MoJ). Section 84 of the FOIA states that in order for a request for information to be handled as a FOI request, it must be for recorded information.

For example, a FOI request would be for a copy of a policy, rather than an explanation as to why we have that policy in place. On occasion, the MoJ receives requests that do not ask for recorded information, but ask more general questions about, for example, a policy, opinion or a decision.

You may wish to re-submit your enquiry to the Ministry of Justice, which will be treated as Official Correspondence. Our contact details are as follows:

102 Petty France
London
SW1H 9AJ

Contact Form:

You can also email us from a personal email address where we can forward your email on to the correct area who can respond to your query directly.

If you do have any questions relating specifically to the FOIA or Data Protection Act (DPA), please contact the Disclosure Team at the following e-mail address: [HMCTS request email]

Kind regards,

The Disclosure Team
