Please provide under the FOIA a copy of what the council are using to enforce non-payment of council tax in place of the prescribed court sealed magistrates court liability order.

The Council Tax (Adminstration and Enforcement) (Amendment) (No. 2) (England) Regulations 2003.

Requests, Northampton Borough Council

The Council has identified this and two other FOI requests received by
this Council and numerous other Councils on Sunday 27^th November 2016 as
substantially similar (relating to the same topic and specific area
(recovery) of that topic). It is therefore this Council’s assessment that
the requests are likely to be from the same person of group. Indeed it
follows similar form and format to a number of requests this and other
councils have been receiving since 2014.

The Council considers these requests are vexatious and designed to cause
annoyance and additional administration. The purpose appears to be
personal not public and as such are caught by Judge Wikleley’s Upper
Tribunal decision (2012 UKUT 440 AAC) in respect of no public purpose. The
number of authorities these requests are sent to means that the term
manifestly unreasonable can also be associated with the requests because
of their vexatious nature, intent and purpose. They could easily have been
sent as one request as they all relate to the recovery of unpaid Council
Tax from the point of liability order. The Council will not be providing
individual responses other than the statements below, numbered to relate
to each request, and will not enter into further correspondence in respect
of any of them unless it be through the Information Commissioner.

989/16 – The Council does not complete any insolvency forms. LGSS (The
Council’s Revenue and Benefits delivery partner) uses an external firm of
solicitors to manage the bankruptcy process.

990/16 – See response NBC4039-1196/15 above. Though fFraudwATCH as a
whatdotheyknow user is now banned from this site this was an alias of Neil
Gilliatt who is still a member of the WDTK site and has indeed annotated
one of the many instances of this request to North East Lincolnshire
Council at

991/16 – As liability orders are obtained to begin the formal recovery
process your request to ask what is used in their place is an invalid
request.

This is a full and final response to all these requests. No further
correspondence will be entered into.

The Council has concluded its review of your requests and upholds the
original response.

 

You now have the right to appeal to the Information Commission’s office.
The Commissioner has suggested this should be within 6 months of the
Council’s final response.

 

The Council will continue to monitor requests on Council Tax and Council
