Title: Council Tax Liability Orders (prescribed forms
omitted since 2003)
Date of reply: 14 December 2016
Summary:
Request for copies of documentation used to enforce non-payment of council
tax.
Question 1
Can you please provide a copy of what the council are using to enforce
non-payment of council tax in place of the prescribed court sealed
magistrates court liability order?
Our response:
The Council does not hold paper copy liability orders for Council Tax.
Liability orders are applied for in one application listing all relevant
cases where a summons has been issued for non-payment of Council Tax and
the balance remains outstanding. Cases where enforcement action is
required are progressed through a list of cases where liability orders
have already been authorised at Magistrates Court.
Dear CCC FOISupport,
I take it a copy can be printed from your computer system. Can you please also confirm does the Magistrates Court seal the Liability Order with a court seal.
Yours sincerely,
mary glister

Court sealing of liability orders, see also [10]FOI 3222: Council tax
liability orders.
Question 1
Can you please confirm whether the Magistrates Court seal the Liability
Order with a court seal?
Our response:
Liability orders are applied for in one bulk application listing all
relevant cases where a summons has been issued for non-payment of Council
Tax and the balance remains outstanding. The Magistrates sign a
certificate in wet ink to confirm authorisation of the application. The
liability orders are not sealed with a court seal.
