Please provide under the FOIA a copy of what the council are using to enforce non-payment of council tax in place of the prescribed court sealed magistrates court liability order.

Thank you for your correspondence received on 21 November 2016. In
response to your request I can now provide the following information. 

 

A copy of what the council are using to enforce non-payment of council tax
in place of the prescribed court sealed magistrates court liability order.

 

The regulations you have quoted removed the need for a liability order to
be in a specified(or similar) format and therefore, enforcement is by way
of a liability order schedule, as specified under schedule 2. We are
unable to provide you with a copy of a schedule as each schedule contains
personal information which is exempt from disclosure under Section 40 of
the Freedom of Information Act 2000. 

 

If you have any queries or concerns please contact me in the first
instance.

 

However, if you are unhappy with the way your request for information has
been handled, you can submit a complaint to [1][Stockton on Tees Council request email] 

 

If, after your complaint has been determined, you remain dissatisfied with
the handling of your request or complaint, you have a right to appeal to

Q1.A redacted copy will be fine

A1. As we have advised in our previous response, we are unable to provide
you with a copy of a schedule as each schedule contains personal
information which is exempt from disclosure under Section 40 of the
Freedom of Information Act 2000. We have enclosed a blank copy of this
documentation.  

 

Q2. Does the Magistrates Court seal the Liability Order with a court seal.

A2. No. There is no requirement for a liability order to be sealed by a
court stamp or seal. A liability order can be issued with the typed name
of the Justices Clerk or senior HMCTS manager who authorises the order on
behalf of the court, even if the order was issued by magistrates.
