Council Decision of 18 July 2018

The request was successful.

Dear Arun District Council,

On 18 July 2018, Arun Council resolved "The Council re-affirms not making any commitment as landowner to enter into any binding legal agreements pursuant to the granting of any planning permission in 2018, for the regeneration of the Regis Centre and Hothamton car park sites under its freehold ownership". This was less than two weeks following the granting of an appeal against refusal of planning permission by the Sir Richard Hotham Project.

The word "re-affirms" means that there was a previous decision, which I cannot locate between the granting of planning permission by the Planning Inspector on 5th July 2018 and that meeting. Please provide date of and link to minutes where such a decision was made.

Also, please provide copies of/ links to any reports etc by Officers, or statements of Cabinet members which were provided to members or members of the Cabinet as a basis for that decision.

In a Report to the Bognor Regis Regeneration Sub-Committee in June 2020, the Director of Place mentioned possible Compulsory Purchase re Whitbread Plc's interest on the Regis Centre site. Please provide copy of any legal advice obtained by the Director or other as the basis for this.

REQUEST:

In respect of the matter related to CPO, it is confirmed that there is no
legal advice because this was raised as a possibility not a certainty.
