I am writing with reference to your FOI request received on 15^th May 2018
regarding Suitability of Amey as provider of waste management services. We
have considered your request under the terms of the Freedom of Information
Act and our response is below.

Cambridgeshire County Council does not hold this information. The waste
PFI contract was originally awarded to Donarbon Waste Management Ltd. Amey
took over the management of the contract following their purchase of
Donarbon Waste Management and the company’s assets in 2010.

Thanks for your reply.

May I please clarify, in case my wording of questions has misled at all. My understanding from the answers to my FOIR is that CCC does not hold this information because risk assessments of Amey in terms of operator performance and supplier suitability were not conducted by CCC, or requested from third parties by CCC. This is the case for when Amey took over the waste management contract from Donarbon. This is also the case with the ongoing consideration by CCC of Amey’s application to provide anenergy from waste facility.

Further to your email below the Waste PFI contract allows the contract to be novated from one company to another in the event of an acquisition such as Amey's acquisition of Donarbon in 2010. The contract does not allow for any assessment of operator performance and supplier suitability in these circumstances, therefore the Authority does not hold this information.

In consideration of the planning application put forward by Amey Cespa East Ltd (S/3372/17/CW), the County Planning, Minerals and Waste Team (as the Waste Planning Authority) cannot give any weight to operator performance.

Donarbon were selected through a public procurement process that requires
assessments of a bidder (such as their Economic and Financial Standing) to
be undertaken in order to be compliant with the Public Procurement
Regulations that were in place at the time.

 

AmeyCespa acquired Donarbon after the procurement process had been
completed, the contract had been signed and service delivery had
commenced.  As stated in previous correspondence on this matter, the
contract does not allow for any assessment of operator performance and
supplier suitability in these circumstances, therefore the Authority does
not hold this information.

I understand that the transfer of the waste PFI contract from Donarbon to Amey Cespa did not allow for any assessment of operator performance and

public procurement regulation assessments in relation to the transfer of
the contract between Donarbon and Amey Cespa, as the contract was not
transferred. All pre-existing contracts between Donarbon and CCC were
inherited by Amey who were, and are still, expected to adhere to the same
conditions that their predecessors agreed to when the contract was
awarded, and that this is the reason why no further assessments of any
kind were required of them.
