I read with interest details of the objections to a docking station in Portland Road, Holland Park (Fulham & Hammersmith Chronicle May 31 2013). Can you please confirm the costs incurred by TfL in responding to the refused planning permission and in the successful appeal with the Royal Borough of Kensington and Chelsea.

about costs relating to planning application for Barclays Cycle Hire
docking station in Portland Road.

the Freedom of Information Act and our information access policy.  I can
confirm we do hold the information you require. You asked:

 

Can you please confirm the costs incurred by TfL in responding to the

We were able to undertake most of the necessary work with existing
resources as part of our normal planning related activity. There was only
one additional cost of £966.36 which was for consultant fees for
additional road safety appraisal. 

 

Secondly can you please share any correspondence which explains further
your ultimate decision to re-site the docking station in the face of local
opposition?

 

Please find attached a copy of the email which we sent to local
Councillors.

 

However, in accordance with the FOI Act, we are not obliged to supply you
with the email addresses of these individuals as they are subject to a
statutory exemption to the right of access to information, under section
40(2) of the Act.

 

In this instance the exemption has been applied as this information
constitutes the individuals’ personal data. Disclosure of this personal
data would be a breach of the Data Protection Act (DPA), specifically the
first principle of the DPA which requires all processing of personal data
to be fair and lawful. It would not be fair to disclose this personal
information when the individuals have no expectation it would be disclosed
and we have not satisfied one of the conditions of Schedule 2 of the DPA
which would make the processing lawful.

 

This exemption to the right of access to information is an absolute
exemption and not subject to an assessment of whether the public interest
favours use of the exemption.
