Cost of misconduct cases involving senior officers

Dear Scottish Police Authority,

Senior police officers (i.e. Chief Constable, Deputy Chief Constables and Assistant Chief Constables)are subject to discipline regulations administered by the SPA (1996 and 2013 as appropriate).

For the financial year 2013/14 could you please answer the following for each of the three ranks

1. The total cost incurred by the SPA for legal services, including advice, opinions and meetings or employing the independent solicitor mentioned in the regulations for which a charge was made against the SPA for cases under the 1996 and 2013 regulations respectively

2. Which legal firms were engaged during 2013/14 for those cases?

3. The basis on which they were selected to provide the advice in that year?

4. Please supply any guidelines and or policy in the SPA regarding the supply of legal services; e.g. procurement levels and authorities, such as European limits and advertising the awarding of contracts?

5. If legal services have been obtained for those cases from any local authority or other body with legal services, which body was engaged and how much was the SPA cross charged (charged) for the legal services provided by them in that year?

6. How much of those costs included reimbursement of reasonable costs incurred by the officer subject of a misconduct investigation under the 1996 regulations?

7. What was the difference (if any) between those reasonable costs claimed in 6 above and the amount actually reimbursed?

I am writing to request an internal review of Scottish Police Authority's handling of my FOI request 'Cost of misconduct cases involving senior officers'.

(1) specifies the total cost incurred in the 2013/14 financial year but your responses introduces the phrase "to date" which I assume to be the date of your reply.

You make no mention of payments to DLA Piper in your response (which I would include in total costs)

For clarity I am asking for the entries that will appear in the SPA accounts for 2013/14 and I appreciate that there can be some delay in submission of final invoices.

By inference the payment (subject to any revision in the light of the above) to Levy & McRae is in fact the answer to 6 for which you say you hold no information?

Costs are not necessarily limited to legal costs so I accept that the figure may be higher even if Levy & McRae have not submitted firther invoices for the 2013/14 period.

Given that I have established that you do hold information relating to (6) it follows that you probably have information about (7) given the usual legal taxation procedures?
